한국의 사전재해영향성검토 제도운영 개선방안 연구 = Improvement of Preliminary Disaster Inspection and Consultation System

국문 초록 (Abstract)

본 연구는 현재 시행 중인 사전재해영향성검토 협의제도의 실효성 증진을 위하여 검토의견 분석을 통해 해당 제도의 개선방안을 제시하고자 하였다. 최근 경기도 행정계획과 개발사업 문서 분석을 통하여 도출한 현행 사전재해영향성검토 관련 문제점은 1) 행정계획과개발사업 검토의 차별성 부재와 이로 인한 실효성 문제, 2) 행정계획 협의의견 반영 미흡, 3) 검토위원 분야 간 충분한 논의 부재, 4) 협의내용 미 이행 사업장에 대한 실효성 없는 제재수단과 제한적인 이행실태 점검, 5) 객관적 검토 및 판단의 어려움 등으로 요약가능하다. 정책적 함의로서 다섯 가지 문제점을 극복함과 동시에 보다 실효성 있는 사전재해영향성검토 제도의 운영을 위하여 일곱 가지 개선방안을 다음과 같이 제안하였다. 1) 행정계획 검토서 및 검토의견 작성의 기준 보완, 2) 관계부처 협조를 통한 합동점검과 과태료 및벌점부과, 3) 객관적 검토 및 판단을 위한 근거마련, 4) 회의소집을 위한 조례개정 및 위원회 정비, 5) 검토위원에 의한 조치계획 및 결과 확인 절차 강화, 6) 취약성 분석 시 분석의 공간범위 확대 및 구체적 조치계획 요구 7) 사전재해영향성검토 협의제도 운영 교육이다.

다국어 초록 (Multilingual Abstract)

The main purpose of this study is to develop implications for the improvement of current PDIS(Preliminary Disaster Inspection System)in Korea by assessing the practical applications of the system in Gyeonggi-do, Korea. Through the case reviews, the assessmentreveals the following five problems of the current system: 1) no discrepancy between administrative and development plan reviews; 2)insufficient consideration of review comments during the implementation procedure; 3) lack of communication among the committeemembers; 4) lack of effective sanctions or measures to control following implementation actions; and 5) lack of proper tools to supportthe committee members' objective reviews or decisions. As implications, seven recommendations are addressed as follows: 1) criteriamodification for administrative and development plan reviews, 2) cooperation with related parties for joined inspection andpenalty system, 3) data development for decision making, 4) review of ordinance and committee meeting systems, 5) tight review processby committee members, 6) enlarged spatial analysis frame for vulnerability analysis and requirement of detailed follow upactions, 7) education program development for the review system.
