소송에 있어서 증명의 정도는 다툼이 있는 사실의 존재에 대해서 법원이 어느 정도의 심증을 형성하면 그 사실을 존재하는 것으로서 취급해야 좋을지를 결정하는 개념을 말한다. 법원이 어떤 사실이 증명됐다고 인정하기 위해서는 그 사실의 존재 여부에 대한 심증이 일정한 정도에 이르는 것이 필요하다. 이때 요구되는 심증의 정도를 증명도라고 한다. 이 증명도는 일반적으로는 단지 ‘그 사실이 있는 것 같다’는 정도로는 부족하지만 ‘반대의 가능성이 전혀 없다’는 정도의 절대적 확신일 필요는 없다. 민사소송에서의 증명의 정도에 대해서 통설과 판례는 일반인이 의심을 품지 않을 정도의 고도의 개연성을 필요로 한다. 여기서 사실인정의 대상은 ‘사실’이고 법적 평가로서의 판단은 아니다. 그러나 실제로는 순수 사실뿐만 아니라 사실과 법적 평가로서의 판단이 뒤섞인 것이 사실인정의 대상이 되는 것이 많다. 예를 들어 어떤 물건을 팔았다는 사실을 인정할 경우, 그 사실은 매우 엄격히 말하면 ‘어떤 문서를 작성했는지’, ‘어떤 대화를 나누었는지’, ‘그 전후에 어떤 사정이 있었는지’ 등과 같은 사실을 확정한 후에, 그런 사실이 있다면 원피고 사이에 매매계약이 있었다고 ‘평가’할 수 있다는 판단을 하는 것이 정확하다. 즉, 매매사실을 인정한다고 해도 통상 거기에는 법적 평가가 포함된 것은 부정할 수 없다. 이처럼 어떤 사실에는 대부분의 경우 다소간 법적 평가의 요소가 혼합되어 있다. 그러나 이 같은 엄밀한 분석은 무의미하다. 매매는 사실이 인정의 대상이 된다고 생각해도 큰 불편은 없다. 그러므로 ‘인정’은 사실인정을 의미하며, ‘판단’은 법률판단 즉, 법령의 해석과 적용에 관한 판단을 의미한다.
사실인정에는 자유심증주의를 취하고 있다. 그러므로 마침내 사실인정은 해당 구체적 사건을 담당하는 판사의 전인격적 가치판단에 따른다. 그러므로 판사의 판단 영역의 밖의 것은 인정이 안 된다. 재판관은 자유심증주의라는 미명하에 전인격적 판단을 남용하고 안이하게 사실인정을 하는 것이 허용되지 않는다. 사실인정은 경험법칙과 논리법칙에 따른 다수의 증거, 간접사실을 분석 종합해서 그 양식과 추리를 더하여 합리적으로 도출해야 한다. 하지만 이런 작업을 추상적으로 말한다 해도 사실인정이 제대로 이뤄지지 않은 위험을 충분히 방지할 수 없는 것이다. 법관으로서는 평소부터 구체적 사건에 적용되어야 하는 경험칙과 이를 배제하는 특별한 사정 등의 연구를 겸허하게 수행하고 사실인정에 대한 국민의 납득과 신뢰를 획득 하도록 힘써야 한다.
본고는 미국 민시소송의 입증책임의 분배를 논의하는데 특히 입증책임의 분배론과 관련하여 법경제학적 분석에 의한 증명책임의 분배론의 구축을 고찰하였다. 한편, 민사소송에서의 증명의 정도와 관련하여 증거제출 책임이 있는 경우 증명의 정도와 설득책임의 경우 증명의 정도를 나누어 논의하였다. 물론 이 경우에도 법경제학적 분석론에 대한 비판과 반박을 검토하였다.

The degree of proof in litigation refers to the concept of determining on what degree the court should treat the existence of a contested fact as an existence. In order for a court to admit that a fact has been proven, it is necessary for the court to have a certain degree of impression regarding the existence of the fact. At this point the degree of the required impression is called the degree of proof. This proof is generally not enough to say that ‘it seems to be true,’ but it does not necessarily have to ‘be absolutely certain that there is no possibility of opposition.’
Regarding the degree of proof in civil litigations, the majority view and case holdings require a high degree of probability that the public will not have any doubt. Here, the subject of fact-finding is ‘fact’ and it is not judged as a legal evaluation. In reality, however, it is a fact that not only pure facts but also facts and judgments as judicial judgments are mixed. For example, if you admit that you sold something, the facts are very strictly stated, such as “what kind of document you wrote,” “what kind of conversation you did,” “what happened before and after that.” After that, it is correct to judge that there was a contract between the plaintiff and the defendant if such a fact exists. In other words, even if the fact of selling is acknowledged, it cannot be denied that it usually includes legal evaluation.
As such, in some facts, in most cases, are somewhat mixed in elements of legal evaluation. But such a rigorous analysis is pointless. There is no great inconvenience to think that the sale is subject to recognition. Therefore, ‘recognition’ means recognition of facts, and ‘judgment’ means judgment about the interpretation and application of the law.
There is a principle of free evaluation of evidence in the acknowledgement of facts. Therefore ultimately, the accreditation of fact is based on the judgment of the judge in charge of the specific case. Therefore, concepts outside the judgment area of the judge is unacceptable. Judges are not allowed to abuse their entire personal judgment under the guise of freedom of conscience and to readily accept facts. The facts should be reasonably derived by summing up and analyzing the numerous facts and indirect facts according to the laws of experience and logic and the addition of form and reasoning. However, even if we abstractly do this, we cannot sufficiently prevent the risks that the facts have not been properly recognized. Judges should humbly conduct researches utilizing empirical rules that should be applied to concrete cases and excluding special circumstances, and try to gain the public’s understanding and trust in the fact-finding process.
This paper discusses the distribution of the burden of proof of the U.S. civil litigation, especially the construction of the distributive theory of the burden of proof pertaining to legal-economic analysis. On the other hand, in relation to the degree of proof in civil litigation, the degree of proof of cases that require the presentation of evidence and that in case of persuasions are discussed separately. Indeed in this case as well, criticism and refutation of legal economic analysis are also examined.
