경찰내사의 효율적 통제방안에 관한 연구

국문 초록 (Abstract)

경찰의 수사개시권과 진행권을 규정한 형사소송법이 개정되어 경찰의 수사주체성이 명문화 된 상황에서 검사의 수사지휘 범위에 경찰의 내사가 포함되는지 여부와 내사범위에 대해 검찰과 경찰간 논란이 되고 있다. 내사는 법적 개념이 아니며, 수사와의 관계 속에서 그 한계가 설정되므로 내사의 개념과 근거, 내사와 수사의 구별 및 경찰내사 처리 실태 등을 살펴보면서 경찰내사의 자율성 여부 등 쟁점에 대해 검토하고, 경찰내사를 효율적으로 통제하기 위한 제도적 개선방안을 제시해 보았다. 본 연구를 통해 경찰내사는 검사의 지휘 및 통제로부터 자율성이 있으며, 변화된 수사주체에 맞도록 책임성을 강화하고, 내사처리를 효율적으로 통제하는 것이 보다 중요하다고 판단되었다. 입건위주의 내사 개념에서 탈피하여 새로운 범죄인지 개념을 정립해야 하고, 피내사자의 인권보장을 위한 구체적인 규정을 마련해야 하며, 내사종결위원회를 구성하여 투명하고 공정한 내사종결처리를 도모할 필요가 있으며, 내사의 신속한 처리와 내사종결시 진정인과 피내사자에게 종결사유와 내용을 통지하여 형식적 마무리를 확실하게 하고, 피내사자 신병확보에 있어 정당성과 절차적 규정을 준수하고, 경찰내부 단계별 보고와 지휘, 감사를 철저히 하여 내부 감시기능이 원활히 유지되도록 하는 등 효율적인 통제방안이 요망된다.

다국어 초록 (Multilingual Abstract)

Under the stipulation of independence of the police since the amendment of “Criminal Procedure Act” which defines the rights of investigation initiation and implementation, disputes over whether pre-investigation of the police is included in the range of investigation supervision by public prosecutors and over range of pre-investigation are arising between the prosecution and the police. As pre-investigation is not legal concept and the limitations are established in relationships with investigations, this study aimed at understanding concept and grounds of pre-investigation, distinction between investigation and pre-investigation, actual situations of pre-investigation process, etc., reviewing autonomies of police pre- investigation and suggesting institutional improving methods to control effectively pre-investigation of the police. Through this study, it was understood that police pre-investigation has autonomy from supervision and control of the prosecution and reinforcement of responsibilities to satisfy change of investigation principal and effective control on pre-investigation process is more important. Effective control methods are desired in that specific regulations for safeguard for human rights of subjects of investigation should be prepared, transparent and fair closing of pre-investigation should be sought by composing committee of pre-investigation closing, definite formal closing should be made with notice of closing reasons and contents to petitioners and subjects of pre-investigation at closing along with prompt process of pre-investigation, justification and procedural rules should be complied in securing whereabouts of subjects of pre-investigation and internal surveillance function should be smoothly maintained through strict report, supervision and audit in police internal phases.
