치료명령제도의 효과성과 제도개선을 위한 연구

국문 초록 (Abstract)

정신질환 범죄자는 꾸준히 그 수가 증가하고 있으며 이들의 재범률은 일반 범죄자에 비해서 높다. 또한, 정신질환 범죄자 중 강력범죄의 비율은 일반 범죄자의 비율보다 5배 이상 높은 것으로 나타났다. 기존 처벌을 중심으로 한 정신질환 범죄자 처우의 효과성에 의문이 제기되면서, 2016년부터 대안적인 사법형태의 하나인 치료명령 제도가 시작되었다. 제도 시행 6년째가 되었지만, 아직까지 치료명령제도의 효과성에 관한 실증적인 연구는 부족한 상황이다. 본 연구의 목적은 치료명령 제도운영의 효과성 및 개선방안을 도출하여, 실효적인 제도의 형성이나 효과적인 운영을 위한 기초자료를 제공하는 것이다. 이를 위해서 본 연구는 보호관찰소에서 치료명령을 담당하는 실무자 중 경험과 지식이 풍부한 보호관찰관을 대상으로 초점집단면접을 진행하였다. 분석결과, 본 연구에서는 ‘목적에 부합하는 운영’, ‘참여자의 특성을 반영한 치료명령’, ‘실무자를 위한 지속 가능한 업무환경조성’, ‘정신질환 범죄자를 위한 체계적인 접근’ 등 4개의 하위주제가 도출되었다. 연구 결과를 바탕으로 정신질환 범죄자를 대상으로 하는 치료명령제도의 효과적인 운영을 위한 실천적 · 정책적 함의를 논하였다.

다국어 초록 (Multilingual Abstract)

The number of offenders with mental illness is steadily increasing, and their recidivism rate is higher compared to offenders without mental illness. In addition, the rate of severe crime by mentally ill offenders was five times higher than general criminals. As questions were raised about the effectiveness of the current punishment-centered approach for offenders with mental illness, the treatment order started as an alternative criminal justice system in 2016. While it has been only 5 years, there is lack of empirical studies about the treatment order. The purpose of this study is to evaluate the effectiveness of the treatment order and provide the alternatives for better operation by conducting in-depth interviews with probation officers in charge of treatment orders. As a result of the analysis, in this study, four sub-themes were derived: Operation suited to the purpose, Treatment order by participants’ characteristics, Providing sustainable work environment for practitioners, and Systematic approach for offenders with mental illness. Based on the research results, policy and practical implications for the effective operation of the treatment order for offenders with mental illness were discussed.
