냉전이 종식된 후 민간군사기업(Private Military Companies: PMCs)이라는 새로운 형태의 행위주체(actors)가 무력충돌 상황에 뛰어들었다. 역사적으로 볼 때 ‘국가(States)’가 통치단위로 등장한 것이 불과 4백년 정도밖에 되지 않은 것을 생각하면, 국가의 군대에 의한 조직적인 안보영역의 전담 또한 같은 시간 길이에 지나지 않을 것이다. 그럼에도 불구하고 상식적으로 시민의 안전을 보장하는 것이 정부의 가장 본질적인 업무 중 하나이며 따라서 사회를 보호하는 무력 즉 ‘군대’는 정부의 전유물이 되어야 하는 것이 전제가 된다. 이러한 현대사회 공통의 상식의 선을 넘어 오늘날에는 ‘기업’이 국가의 안보를 책임지도록 전환되고 있으니 그러한 논의의 중심에 있는 것이 민간군사기업이다.
국가가 아닌 기업이 무력충돌상황 중에 행한 행위에 대해 지는 권리와 의무를 논의하기 위해서는 우선 민간군사기업의 법적 지위가 확정되어야 한다. 법적 지위는 민간인으로 볼 것이냐 또는 전투원으로 볼 것이냐의 구분으로 나누어진다. 왜냐하면 민간인이냐 또는 전투원이냐에 따라 공격여부와 보호여부가 다르게 판단되기 때문이다.
제네바협약 제Ⅰ추가의정서 제43조 제2항은 충돌당사국의 군대구성원은 전투원이라고 규정하고 있다. 즉, 국가의 군대에 의해 고용되어 그 구성원으로 활동하는 자는 전투원이 되는 것이다. 이와 더불어 그 제Ⅲ협약 제4조 제1항 ⒝호에서는 “그들 자신의 영토내외에서 활동하는 기타의 민병대의 구성원 및 기타의 의용대의 구성원”으로 보고 4가지 요건인 “⑴ 그 부하에 대하여 책임을 지는 자에 의하여 지휘될 것 ⑵ 멀리서 인식할 수 있는 고정된 식별표지를 가질 것 ⑶ 공공연하게 무기를 휴대할 것 ⑷ 전쟁에 관한 법규 및 관행에 따라 그들의 작전을 행할 것”을 충족하면 이들을 포로로 인정하고 있다. 제4조 제1항 ⒝호의 ‘충돌당사국에 속하는’이라는 표현이 국가의 ‘명시적 인가(explicit authorization)’를 요구하지 않는 ‘사실상 관계(de facto relationship)’로 충분한 것으로 종결지어졌으므로 이들이 “국가에 의한 이들 민병대 내지 의용대의 구성원에 대한 감독이 있어야 하며 ‘종속과 충성’의 관계”에 있으면 이들을 전쟁포로로 인정받을 것이다. 병참지원을 목적으로 하는 민간군사기업의 임원의 경우에는 군대의 구성원이 아니면서 군대에 수행하는 자로 분류되어 전투원이 아닌 것을 살펴보았다.
타국의 무력충돌에 참여한 동 임원의 경우 이들이 용병인지에 대해 살펴본 바, 제147조 제1항 ㈏호, ㈑호, ㈒호로 이들은 용병신분에서 벗어나 있었다. 제47조 제1항 ㈏호는 “실지로 적대행위에 직접 참가하는 자”를 요건으로 하는데 ‘실지로… 직접’ 참가하는 자에 대한 범위를 확정하기가 어렵기 때문이다. 다만, 핵심군사행위를 한 임원들은 ‘실지로 적대행위에 직접 참가한 것’으로 볼 수 있을 것이다. 둘째, 현재 실제로 이라크전쟁에서 활동하고 있는 많은 민간군사기업의 임원들은 ㈑호에 의해 용병에서 제외된다. ㈑호는 “충돌당사국의 국민이 아니거나 충돌당사국에 의하여 통치되는 영토의 주민이 아닌 자”로 규정하고 있는데 미국이 실제 충돌당사국이기 때문에 미국에 설립근거지를 두고 있는 민간군사기업의 임원들은 용병의 정의에서 제외되며, 영국의 민간군사기업도 동일한 이유로 용병의 정의에서 제외된다. 또한 이라크주민으로서 미군을 위해 일하고 있는 자도 영토의 주민이므로 용병의 정의에서 제외되어 현재 실제 상식적으로 용병이라고 생각되는 대부분의 임원들이 용병의 정의에서 제외된다. 셋째, ㈒호는 “충돌당사국의 군대구성원이 아닌 자”일 것을 요구하므로 국가가 원하는 경우에는 민간군사기업의 임원들을 군대구성원으로 임명함으로써 용병의 정의에 포함되는 것을 피할 수 있다. 결과적으로 이들은 합법적인 전투원으로 직접적으로 적대행위에 참여할 권리가 있으며, 적군에게 체포되면 전쟁포로로서 인정되고 제네바 제Ⅲ협약에 의해 보호를 받으며, 단지 적대행위에 참여했다는 이유로 재판에 회부되지 않는다는 것을 의미한다.

With growing number of private military companies acting in armed conflicts situation has been accompanied by rising concern about the role of the private companies which include the responsibilities of companies and those working for the companies under international humanitarian law.
With respect to Article 4 and Article 43 of the Ⅲrd Geneva Convention, distinction between persons taking active part in armed conflicts and those who do not can be established. The term "combatant" has a very specific meaning under international humanitarian law. Article 43 states members of state's armed forces are combatants.
Article 4 guarantees a little bit of extended protection for those who are captured during armed conflicts to be Prisons-of-War. Article 4⑴⒝ includes members of other militias and of other volunteer corps, including those organized resistance movements, belongs to a state party to an armed conflict, provided that such militias or corps fulfill 4 conditions listed.
Besides, in order to be considered combatants on the basis of this provision, the group as a whole must "belong to a party to an international armed conflict". The term "belong to a party to an international armed conflict" was interpreted as requiring "de facto relationship" and "control over the militia or volunteer group by the state" is the nature of link necessary for those to be considered "de facto relationship". Therefore, if other conditions are met, those fighting actively in the field satisfies the condition required to be a combatant. However, those not taking a direct part in hostilities and doing only indirect work such as laundry, cooking, providing shelter to combatants can not be considered a combatant.
Another factor to consider is whether those workers of private military companies can be considered as mercenaries. Article 47 of Additional Protocol Ⅰ lays down a definition of it and unfortunately the cumulative conditions acting as obstacle to view them as mercenaries.
Article 47⑵ of the Additional Protocol Ⅰ defines as any person who: ⒜ is specially recruited locally or abroad in order to fight in an armed conflict; ⒝ does, in fact, take a direct part in the hostilities; ⒞ is motivated to take part in hostilities essentially be the desire for private gain and, in fact, is promised, by or on behalf of a party to the conflict, material compensation substantially in excess of that promised, by or an paid to combatants of similar ranks and functions in the armed forces of that party; ⒟ is neither a national of a party to the conflict nor resident of territory controlled by a party to the conflict; ⒠ is not a member of the armed forces of a party to the conflict; and ⒡ has not been sent by a state which is not a party to the conflict on official duty as a member of its armed forces.
Applying current condition to the definition of mercenaries ⒠, those hired by a state and if certain conditions are met, those working for the PMCs may be considered members of the armed forces and consequently most of PMCs workers will fall out of the definition. In addition to that, requirement ⒟ also excludes most of U.S., U.K., and Iraq workers of PMCs hired by these states or any other actor in Iraq.
As a result, as combatants most of PMCs workers will be entitled to prison of war status and maynot be prosecuted for having participated in hostilities.
