A Study on the Effective Implementation of the Ship Recyling Convention

국문 초록 (Abstract)

선박재활용작업(선박해체작업)은 주로 인도, 방글라데시 등 안전 및 환경시설 등이 제대로 갖춰지지 않은 해변위에서 인부들의 수작업으로 행해져왔기때문에 작업자의 사망, 부상 및 시설주변의 환경오염 등의 문제들을 야기해왔고, 그 결과 지속적으로 안전․환경문제에 관한 국제적인 주목을 받게 되었다. 관련 연구에 따르면, 인도에서 1984년부터 2000년까지 재활용되는 선박수가 증가하면서 사고로 인한 작업자의 사망자수도 비례하여 증가해 왔다고 한다. 또한, 다른 2003년도 보고에 따르면 재활용시설 근처 해변에 누적된 폐기물의 양이 하루 평균 약 96톤 정도에 이르러 환경에도 심각한 악영향을 미쳐왔다고 한다. 국제해사기구(IMO)는 1998년 제42차 해양환경보호위원회(MEPC)에서 선박재활용으로 인한 안전 및 환경 관련 문제의 논의를 시작하였고, 2009년 5월 홍콩에서 “안전하고 환경적으로 건전한 선박 재활용을 위한 국제협약 (이하, “선박재활용협약”이라 함)”을 채택함으로써 그 결실을 맺었다. 하지만, 선박재활용협약의 채택이 선박재활용과 관련한 안전·환경문제를 해결해주는 것은 아니며, 동 협약의 효과적인 이행만이 이와 같은 문제를 본질적으로 해결하는 방법일 것이다.
이에 본고에서는 선박재활용협약의 이행 주체인 기국, 선박재활용국, 항만국의 의무 및 준비사항 등에 대한 검토를 통해 협약의 효과적인 이행방안을 제시하고자 한다. 이를 위해 먼저 동 협약하에서의 기국의 의무에 대하여 검토하였고, 이러한 의무를 이행하기 위하여 기국이 준비해야 될 사항에 대하여 현행 IMO 회원국감사제도의 틀을 이용하여 식별하였다. 또한, 지금까지 IMO협약 상에서 존재하지 않았던 새로운 국가 형태인 선박재활용국에 대해서는 기국과 동일한 방식으로 협약의 효과적인 이행을 위하여 이들이 준비해야 될 사항을 식별하였다. 추가적으로 협약의 효과적인 이행을 위해 기국, 선박재활용국, 항만국이 상호 협조 하에 취해야 될 조치에 대하여 검토하였다. 마지막
으로 결론에서는 선박재활용협약의 효과적인 이행에 영향을 미치는 외부적인 요소들에 대하여 식별하고 이를 해결하기 위한 방안에 대하여 제시하였다.

다국어 초록 (Multilingual Abstract)

This paper is a study concerning how the Ship Recycling Convention will be effectively implemented in order to achieve the ultimate goal of the Convention. As a way to identify the necessary measures that should be taken to ensure the effective implementation of the Ship Recycling Convention, obligations of a flag State under the Ship Recycling Convention are briefly examined and the A Study on the Effective Implementation of the Ship Recycling Convention 3 consequent implications for the flag State are identified through the application of the framework of the audit standard in the Code for the Implementation of Mandatory IMO Instruments. Furthermore, obligations of a recycling State are also briefly examined and the consequent implications for the recycling State are identified in the same way as for the flag State. Then, as the last necessary measure to ensure effective implementation, the relationship between a flag State, a recycling State and a port State is examined. In the concluding section, the factors affecting the effectiveness of the Ship Recycling Convention are identified and consequently the ways to ensure the effectiveness of the Convention itself are proposed.
