북한의 문화유산 소유권 인식에 관한 연구 = Study on Perception of Ownership of Cultural Heritage in North Korea

국문 초록 (Abstract)

이 논문은 김정은 집권 이후 북한의 문화유산 소유권 인식을 알아본 연구이다. 법적으로 2012년 제정된 문화유산보호법과 2015년 제정된 민족유산보호법에서는 문화유산 소유권과 관련하여 상충하는 내용을 포함한다. 문화유산보호법에서는 상속 및 승계된 문화유산의 개별적 소유를 인정하고 있으나, 민족유산보호법에서는 모든 문화유산의 국가적 소유를 명시하고 있다. 한편 북한 매체에서는 개인 소유 유물의 기증 증서 발급으로, 개별적 소유 유형문화유산의 국가로의 소유권 이전이 발생하게 된다. 무형 문화유산의 경우, 개인 고유의 기술을 그의 자손에게 전습하여 가족 내 머무르게 하고, 고유 활동으로 인한 경제적 이익 역시 해당 가문을 벗어나지 않도록 하고 있다.

This paper is a study examining the perception of ownership of cultural heritage in North Korea after Kim Jong-un took power. Legally, the Cultural Heritage Protection Act enacted in 2012 and the National Heritage Protection Act enacted in 2015 contain conflicting provisions regarding ownership of cultural heritage. The Cultural Heritage Protection Act recognizes individual ownership of inherited and inherited cultural heritage, but the National Heritage Protection Act specifies national ownership of all cultural heritage. Meanwhile, in North Korean media, the transfer of ownership of individually owned tangible cultural heritage to the state occurs through the issuance of donation certificates for privately owned artifacts. In the case of intangible cultural heritage, an individual's unique skills are passed down to his or her descendants so that they remain within the family, and economic profits from unique activities are also ensured to remain within the family.
