왜 동아시아 재판소는 없는가? = 지역사법제도와 동아시아 지역통합

다국어 초록 (Multilingual Abstract)

This study is a political analysis to explain why there is no regional court in East Asia from a comparative perspective of Europe, Latin America, and Africa. This study suggests a new hypothesis to argue that states attempt to build a regional court when they desire to achieve a deeper integration beyond a custom union in their region through the process of legal transplants. This study also argues that the process of legal transplants for creating a regional court has an important political effect of institutionalizing the non-compliance of private actors against the regulatory authority of the state. Based on the suggested new hypothesis, this study concludes that the absence of a regional court in East Asia can be explained by the nature of East Asian states as the status quo state who perceive their situations as a domain of gains. In particular, East Asian states do not have strong motivations to change their current situations of the state-society relations in which they ensure the compliance with the state regulatory authority in their domestic politics as well as the anarchical nature of international system in East Asia.
