WTO 補助金協定과 IT 新成長動力 發展戰略 = WTO Agreement on Subsidies and Countervailing Measures and Korea's Strategy for Developing New Growth Engines in IT Sector

국문 초록 (Abstract)

정부는 IT산업의 성장한계 극복 및 새로운 재도약을 목표로 하는 산업정책의 일환으로 최근 9가지 미래산업 육성을 위한 소위 'IT 신성장동력 발전전략'을 추진하고 있다. 이러한 육성정책은 선정된 산업분야에서 수행되는 기술개발에 대한 정부의 재정지원으로 특징 지워진다. 본 논문은 IT 신성장동력 발전전략의 통상문제화 가능성에 주목하면서 WTO협정, 특히 보조금협정 위반 가능성에 대해 분석한다. 그 결과에 따르면, 이러한 육성정책은 그 자체로 보조금협정 위반이라고 볼 수는 없다. 그러나 정책적 성공을 전제할 경우, 보조금협정 상의 상계가능보조금 규정 준수의무와 관련한 통상마찰에 휘말릴 가능성을 배제할 수 없다. 향후 정책 추진 과정에서 특히 기술개발 지원대상 선발기준, 정부 재정지원의 운용방식 및 재정지원 기간 등과 관련하여서는 각별한 주의가 요망된다.

다국어 초록 (Multilingual Abstract)

The Korean government is actively promoting an industrial policy, so-called, 'Strategy for Developing New Growth Engines in IT Sector,' which selectively cover nine next-generation industries. The main objective of this initiative is to overcome the growth limits of Korea's overall IT sector by leaps and bounds. The policy is characterized by Korean government's financial support for technology development activities carried out in the targeted industries. This study examines whether this promotion policy conforms, inter alia, to the WTO Agreement on Subsidies and Countervailing Measures, taking note of the possibility to trigger trade disputes. Based upon the results of the study, the policy as such is not a breach of the WTO Agreement on Subsidies and Countervailing Measures. Nonetheless, a plausible scenario is that the success of this policy drive could give rise to trade frictions on Korea's compliance with the provisions on actionable subsidies in the Agreement. The Korean government is suggested to pay particular attention to the implementation of the support program, especially, as to the discretion criteria for support the manner and length of granting public funds to relevant private entities.
