    본 논문은 간도(間島) 강역의 역사적 형성과정을 고찰하고, 해당 지역이 중국 영토로 편입되는 역사적 배경과 불법성을 고찰하였다. 1627년 정묘호란 이후 조선과 청 사이에 체결된 강도회맹에서는 간도 지역의 구체적인 국경선이 명확히 확정되지 못하였다. 이후 1712년 조선과 청은 백두산 일대의 현지답사를 실시하고 백두산정계비를 설치하여 국경을 비문에 명시하였다. 비문에서는 동쪽 경계를 ‘토문강(土門江)’으로 기록하였으나, 해당 하천의 위치 및 명칭 해석을 둘러싼 논쟁으로 인해 국경 문제는 지속적으로 제기되었다. 본 연구는 백두산정계비의 비문 내용과 조선·청 양국의 사료, 그리고 18세기 제작된 지리 자료를 종합적으로 검토하였다. 특히 1737년 프랑스 지리학자 당빌이 제작한 『신중국지도』에 나타난 국경 표기를 분석하여 당시 국제적 지리 인식 속에서의 간도 경계 인식을 살펴보았다. 또한 1909년 체결된 간도협약의 성립 과정을 검토하여, 해당 협약의 불법성을 고찰하였다.
    이를 통해 간도 지역의 역사적 귀속 문제와 근대 국제질서 속에서의 영토 편입 과정을 재조명하였으며 불법적인 조약에 의해 편입된 간도 강역이 한국의 영토로 회복 되어야 하는 정당성을 확인했다.

    This paper examines the historical formation process of the Gando (Jiandao) territory and investigates the historical background and legal invalidity surrounding its incorporation into Chinese territory. Following the 1627 Jeongmyo-horan (the Manchu invasion of Korea), the Gangdo-hoemaeng (the Treaty of Ganghwa) between the Joseon and Qing dynasties failed to establish a clearly defined boundary for the Gando region. Subsequently, in 1712, both nations conducted a joint field survey of the Mount Baekdu area and erected the Baekdusan Boundary Stone (Stele) to formalize the border. While the inscription designated the "Tomun River (土門江)" as the eastern boundary, persistent territorial disputes arose due to conflicting interpretations regarding the river’s exact location and nomenclature.
    This study provides a comprehensive review of the inscription on the boundary stone, historical records from both Joseon and Qing, and 18th-century geographical data. In particular, the research analyzes the territorial demarcations in the Nouvel Atlas de la Chine (1737) by French geographer Jean-Baptiste Bourguignon d’Anville to explore international geographic perceptions of Gando’s boundaries at the time. Furthermore, the study scrutinizes the formation process of the Gando Convention (1909) to highlight its inherent illegality.
    Through this, this study sheds new light on the historical sovereignty of the Gando region and the process of its territorial incorporation within the modern international order, while verifying the legitimacy of reclaiming the Gando territory—which was unlawfully annexed—as Korean territory.
