노인일자리사업에 관한 헌법적 연구

국문 초록 (Abstract)

노령인구의 증가는 사회⋅경제발전으로 인하여 생활환경이 개선되고 삶이 윤택해졌고, 의학발전으로 인하여 수명이 연장되면서 자연스럽게 나타난 현상이다. 그런데 급속하게 고령사회로 진입하면서 활발하게 활동하는 생산인구도 증가해야 함에도, 오히려 출산율이 저하되고 젊은 층이 감소하는 노령화지수가 높아지면서 노후를 걱정해야 하는 문제가 발생하고 있다.
제4차 산업혁명의 시대로 점차 진입하면서 인간의 노동력은 로봇과 기계로 대체되고 있으며, 이로 인하여 구조적 실업문제는 인간의 미래를 불확실하게 하고 있다. 특히 은퇴하면서 연금이나 각종 보험의 혜택으로 노후생활을 이어가야 하는 고령자에게는 점차 생활하기 어려운 시대가 되고 있다.
정부는 고령화 사회에서 노인복지를 위해서는 근본적인 대책이 필요하다는 것을 인식하였다. 정부는 2004년 노인복지 차원에서뿐만 아니라 고용창출이라는 차원에서 노인일자리 사업을 추진하였다. 노인일자리 사업은 사회공헌형과 시장진입형으로 구분하고, 전자는 공익형, 교육형, 복지형으로 나누고, 후자는 인력파견형, 제조판매형, 공동작업형 등으로 구분되어 있다.
노인일자리 사업은 기본적으로 노인의 소득증대에 기여하고, 그들의 지식과 경험을 활용할 수 있는 기회를 제공함으로써 사회발전에 기여하게 된다. 그런데 노인일자리를 원하는 사람은 많지만, 정부가 제공하는 일자리는 수요를 충족시키지 못하고 있다. 또한, 노인일자리 사업에서는 원하는 만큼 소득을 올리기 어려워서 취업의 의미를 살리기 어렵다.
노인일자리 사업은 단순히 일자리의 확충이라는 외형적 팽창도 중요하지만, 노인의 은퇴 전 경력, 연령, 학력, 능력과 건강상태 등을 고려하여 일자리의 질적 확충도 필요하다. 그리고 수익을 고려한 시장형 노인일자리 사업의 경우는 공공분야 노인일자리 사업과 균형을 맞추어 추진해야 한다.
노인일자리 사업에서 실질적인 문제는 전문적인 기관에 의하여 계획을 수립하고 추진하는 것이 아니라, 노인들이 직접 운영하는 기관도 많다보니 체계적이지 못하여 효율성이 떨어지는 문제가 발생한다. 이런 경우 노인일자리 사업이 본래의 기능을 하지 못하여 노인복지에 기여하지 못한다.
노인일자리 사업을 추진하는데 또 다른 문제점은 담당부처가 분산되어 있어서 체계적으로 추진되지 못하고 있다는 점이다. 이 사업이 성공적으로 정착하여 발전하려면 수행기관의 역량이 확대되어야 하고, 중앙정부와 지방정부 간의 협력체계 구축, 효율적으로 업무를 분담할 수 있어야 한다.
나아가 노인일자리 사업은 헌법상 노인복지의 실현을 위하여 노력해야 할 국가의 과제라는 점을 분명하게 인식해야 한다. 인간다운 삶과 노인생활의 질적 향상이란 점을 고려하고, 고령화 사회에서 풀어나가야 할 사회문제라는 것을 인식하여 필요한 예산을 확충하고 적극적으로 추진해야 한다.

다국어 초록 (Multilingual Abstract)

The increase in the elderly population affects social and economic development and the environment of human life. However, even if the aged population rapidly increases in aged society, the migration rate of immigration increases and the aging index becomes high.
In the era of the Fourth Industrial Revolution, the human labor force replaces machines and robots in occupation. We must make human future uncertain. A place of life to enhance the quality of life.
The government recognized that in the aging society, fundamental measures are needed for the elderly welfare. In 2004, the government promoted the elderly job project not only in terms of welfare for the elderly, but also in terms of job creation. The elderly job is divided into social contribution type and market entry type. The former is divided into public interest type, education type and welfare type, and the latter is classified into labor dispatch type, manufacturing and sales type, and collaborative type.
The Elderly Jobs Project promotes social development through income increase and experience of the homeless. Not many people like him. In addition, the meaning of employment is difficult to see.
In the elderly job market, it is important to expand the job, but it is also necessary to improve the qualifications of the elderly in consideration of their retirement experience, age, education, ability and health. In the case of the market-type elderly employment project considering profit, it should be balanced with the public sector elderly employment project.
The practical problem in the elderly employment project is not the establishment of a plan by a professional institution, but the problem is that the efficiency of the elderly is low because it is not systematic because many institutions are directly operated by the elderly. In this case, the job for the elderly can not contribute to the welfare of the elderly because it does not function properly.
Another problem in promoting the elderly employment project is that the ministries in charge are dispersed and are not systematically promoted. In order to successfully establish and develop this business, the capacity of the executing agency should be expanded, and the cooperation structure between the central government and the local government should be established and the work shared effectively.
Furthermore, it should be clearly recognized that the job of the elderly is a task of the state to make efforts to realize the welfare of the elderly in the Constitution. Considering the quality improvement of human life and the elderly life, it should be recognized that it is a social problem to be solved in an aging society, and the necessary budget should be expanded and actively promoted.
