벤담의 공리주의와 재분배 = Bentham’s Utilitarianism and Redistribution

국문 초록 (Abstract)

이 논문의 목적은 제러미 벤담의 공리주의가 함축하는 분배양상을 고찰하는 것이다. 그가 자신의 경제학적 저술 전반에서 보여 준 일관된 관심은 빈민의 고통을 줄이는 것이었고, 법적 개입을 통한 빈민의 생계보장에 대한 제안은 당시의 관점에서는 상당히 진보적인 제안이었다. 이러한 제안은 최대 다수의 최대 행복을 궁극적 목적으로 삼는 공리주의의 필연적 귀결일 수 있다. 벤담은 입법자의 거시적 관점에서 이러한 궁극적 목적의 실현에 이바지할 네 가지 종속적 목적들을 설정한다. 그것들은 생계, 풍요, 안전보장, 평등이다. 그런데 이 네 가지 하위 목적들은 서로를 뒷받침하는 동시에 서로를 제약하는 관계에 있다.
이 논문에서 나는 우선 이 네 가지 하위 목적들을 개괄하고, 그중 생계 및 안전 보장과 관련해 벤담이 사유재산권을 강력히 옹호한 배경을 살펴볼 것이다. 다시 그 네 가지 하위 목적들 가운데 하나인 평등과 관련해, 그가 자신이 제시한 한계효용 체감 원리에 대해 어떤 견해를 취했는지를 밝히고, 이를 통해 그가 현실적으로 지향한 평등 혹은 분배의 대략적 양상을 살펴볼 것이다. 마지막으로 그가 다른 세 가지 목적들과 조화를 이루는 한에서 평등의 실현을 위한 실천적 방편으로 제안한 상속제 개혁의 근거를 비판적으로 검토할 것이다. 이러한 고찰을 통해 그의 공리주의에서 재분배 정책의 기능과 한계를 알아보고자 한다.

다국어 초록 (Multilingual Abstract)

The purpose of this paper is to examine the distributive aspect implied in Jeremy Bentham’s utilitarianism. His constant concern in his economic writings was in general to reduce the pain of the poor, and his suggestion for the provision of subsistence for the poor by means of government’s interference was a fairly radical one from the perspective of his time. This suggestion may be a practically necessary consequence of his utilitarianism that pursues as its ultimate end the greatest happiness for the greatest number. Bentham sets up the four subordinate ends conducive to the realization of this ultimate end. They are subsistence, abundance, security, and equality. But they are in a dual relationship that they support and simultaneously restrict one another.
In this paper, firstly, I will briefly summarize those four subordinate ends, and, with regard to subsistence and security among them, look into the theoretical background in which he strongly defended the private property rights. Secondly, with regard to equality among the four, I will scrutinize the position he took for the principle of diminishing marginal utility suggested by himself, and by this bring to light a general outline of the equality or distribution he pursued in practice. Lastly, I will critically examine the grounds of the reform of inheritance law he suggested as a practicable means of the pursuit of equality in so far as harmonized with the three other ends. From this examination, I wish to make out the function and limitation of redistribution policy in his utilitarianism.
