헌법개정의 방향 - 통치구조 개편의 쟁점과 대안 -

국문 초록 (Abstract)

헌법개정은 오랜 동안 정치권과 학계의 관심사가 되고 있다. 개헌의 핵심은 권력구조인데 이를 의원내각제로 할 것인가, 이원정부제로 할 것인가 아니면 4년중임의 대통령제로 할 것인가이다.이와 더불어 지나치게 집중된 대통령의 권한과 대통령의 책임문제와 대통령제를 유지할 경우 부통령제의 도입여부가 관심의 초점이다.대통령의 권한의 집중만을 고려할 때에는 의원내각제가 대안이 될 수 있다. 권력의 공화를 특징으로 한 의원내각제가 국민의 자유와 국가권력의 하모니를 바탕으로 자유를 위한 정치체제로 평가받고 있다. 그러나 우리나라의 경우 이를 도입하기 위한 정치적 환경이 아직 조성되지 않았고 세계적인 정치·경제상의 위기나 남북분단에 따른 문제에 기능적으로 대응하기에는 순발력이 떨어지는 제도라는 문제점이 있다. 이원정부제는 우리 대통령제의 문제점을 해결하기는커녕 문제만더욱 심각하게 한다. 즉 여대야소의 경우에는 대통령은 제왕적 대통령제로 변질되게 되고, 여소야대 이른바 동거정부의 경우에는 대통령과 국무총리가 대립하여 정치적 혼란을 야기하게 된다. 현행제도에 있어 대통령의 권력집중을 막고자 하나 전자의 경우에는 오히려 이를 가중시킬 뿐이다.우리는 단 한 번도 순수한 형태의 대통령제를 해본 경험이 없다. 현행 대통령제의 문제는 거의 전부가 대통령단임제와 국무총리제에세 비롯되는 것이다. 4년중임의 대통령제는 대통령의 정치적 책임을 확보하고 레임덕을 완화할 수 있다. 또한 부통령제는 국민주권원리를 실현하고 정치후계자를 양성하는 가장 좋은 길이며 지역간·계층간의 위화감을 덜 수 있는 제도이다. 여건이 되지 않는 의원내각제, 프랑스에서조차 많은 문제점을 드러내고 있는 이원정부제가 대안이 될 수는 없다.미국식의 순수한 대통령제를 채택하는 길이 유일한 대안이라고 생각하여 이를 헌법개정의 방향으로 제안한다.

다국어 초록 (Multilingual Abstract)

Recently in Korea, the Amendment of the Constitution regarding the political structure of South Korea is a controversial issue. The main issue is the power of the President which is too concentrated and too broad. The form of government is the central issue, and focuses on the choice of: 1) parliamentary government system, 2)dual-cabinet government system(such as France) or 3) US presidential form of government.Focusing only on the powers of the President, the Parliamentary government system can be seen as an alternative. A parliamentary government based on the collaboration of powers is a political system that maintains a balance between people's freedom and power of the state. Compared to the present system in South Korea a parliamentary system is a more ideal type of system for individual freedom. But the politicalatmosphere of Korea is not yet ripe for change. South Korea is faced with a global political and economic, and a plethora of south-north problems. We know, in the time of crises, the parliamentary system is generally not so quick to react.Dual-system government(Régime Semi-Présidentiel) makes the present problems more serious, instead of solving or weakening them. If the President's party and the major party in the Parliament are the same, the President could have, so to speak, unlimited power. And vice versa in a dual-system government, cohabitation is created whereby the President and the Prime Minister are pitted against each other, and political disorder ensues. Dual-system government results in the possible despotic power of the President or political conflicts between President and Prime Minister.South Korea has never experienced a pure presidential form of government in the US. The system of the Korean government has been a mixed one- presidential and parliamentary. Most of the present political problems derive from a single 5-year-term President system and the incompatibility between the presidential system and the Prime Minister system. A re-electable 4-year-term system(8 years total) makes the president more responsible and limits “lame duck”. Adding a vice-president to the system contributes to establish the continuity of constituancy, is one of the best ways to train political leaders and helps to equalize regional and social stratum.The parliamentary system and dual-system government are not the keys to solve South Korea's present political problems. The the best and only way to solve it is to introduce the pure presidential system which includes a re-electable 4 year-term(8 years total) president and vice president.
