재난안전 사무의 민간위탁 실태와 정책방향 : 해양재난관리의 민간위탁을 중심으로

국문 초록 (Abstract)

정부는 불확실한 재난환경에 신축적으로 대응하고, 정부의 경제적 부담을 덜기 위 해서 재난안전에 대한 사무를 민간계약을 통해 위탁관리 방식을 일부 선택하고 있 다. 민간위탁은 공공부분에의 경쟁요소의 반영을 통한 업무의 효율성 및 생산성의 제고, 민간부분의 자본과 전문성 기술·경험 등의 활용을 통한 경제 활성화의 요청에 의해 행정기관이 담당하였던 일부 사무의 처리를 민간부분에 위탁하여 처리하게 되 면서 등장하였다. 본 연구는 재난관리 사무의 민간위탁에 대한 이론적 배경을 탐색 적으로 살펴보고, 해양재난 대응과정에서 드러난 행정사무의 민간위탁 실태분석을 바탕으로 문제점을 살펴본 후 개선방안을 도출하는데 있다. 연구의 결과를 다음과 같이 제안한다. 첫째, 행정기관은 위탁사무에 대하여 민간위탁의 필요성 및 타당성 등을 정기적·종합적으로 판단하여 필요할 때에는 민간위탁을 하여야 한다. 그리고 국민의 권리·의무와 직접 관계되는 사무는 위탁할 수 없도록 한다. 둘째, 재난안전 사무의 민간위탁은 신중하게 위탁사무 범위를 결정해야 하고 책임성 확보를 위해 상 시적으로 관리·감독할 수 있는 제도적 장치를 마련해야 한다. 셋째, 국민이 원하는 안전의 핵심인 인명구조에 대한 국가사무는 민간위탁을 금지하고, 신속한 인명구조 활동을 할 수 있게 해야 할 것이다. 넷째, 예산절감보다 헌법적 가치인 국민의 안전 권은 민간에 위탁할 수 없도록 제도적 장치가 마련되어야 할 것이다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to find out the improvement plan based on the analysis of the contracting out for disaster & safety functions during the marine disaster response process. The results of the study are as follows; First, the administrative agency shall periodically and comprehensively judge the necessity and feasibility of the contracting out for pubic functions and the office affairs directly related to the rights and duties of the public shall not be contracted. Second, disaster & safety functions should carefully determine the scope of the contracting out and should be provided with institutional devices that can be managed and supervised at all times. Third, the national functions of rescue operations, which is the core of safety, should prohibit the contracting out. Fourth, institutional devices should be provided so that the safety of the people can not be entrusted to the private sector.
