성년후견제도 활성화 방안에 관한 연구 = A study for the activation of the adult guardianship system

국문 초록 (Abstract)

종래의 행위무능력자제도는 요보호자의 능력 정도를 획일적으로 규율하고 행위능력을 박탈하거나 제한하고 있으며, 정신적 장애가 있는 자만을 보호의 대상으로 하고 있어 고령자나 신체장애가 있는 자를 보호하는 기능을 하지 못하였다. 또한 한정치산 · 금치산의 선고사실이 가족관계등록부에 그대로 공시되어 개인정보가 침해되는 등 여러 가지 문제점들 가지고 있었으며 이로 인해 현실적으로 거의 이용되지 않았다. 이러한 문제점을 극복하기 위해 성년후견제도가 도입되었다. 이 제도는 사무처리 능력에 도움이 필요한 성인의 재산보호뿐만 아니라 의료행위, 거주지 결정 등 신상에 관한 폭넓은 지원이 이루어지고, 가정법원 또는 후견감독인에 의한 실질적인 후견업무의 감독이 가능해졌으며 특히 요보호자의 자기결정권 존중에 입각하여 입법되었다. 성년후견제도는 자기결정권의 존중과 잔존능력을 활용한다는 점에서 판단능력이 부족한 정신장애인들과 고령화 사회에 접어든 우리사회에 그 활용도가 높게 나타날 것으로 기대되었다. 그러나 성년후견제도가 2013. 7. 1.부터 시행되고 있지만 시행이후 기대한 만큼 활용되지는 않고 있다. 따라서 제도의 활성화를 위해 성년후견제도에 대한 인식의 전환, 서비스 비용에 대한 검토 및 공공후견에 대한 지속적인 연구가 필요하다.

다국어 초록 (Multilingual Abstract)

The incapacity system has regulated the ability of people requiring protection uniformly, deprived or restricted the capacity of them, and has worked only for the people with psychiatric problems. For these reasons, proper protection has been deficient for the elderly and handicapped. Also, because there have been several problems, for example, the announcement of incompetence or quasi-incompetence could be showed by the certificate of family-relationship registration, the incapacity system has not been utilized well. The adult guardianship system were introduced for overcoming these problems caused by the incapacity system. This newly legislated system could give widespread supports for personal cares such as property protection, medical treatment and decision of residence, makes it possible for family courts or supervisors to monitor the appropriateness of guardianship management. The adult guardianship system esteems the self-decision-right of people requiring protection, encourages them to use their remained capacity and this system is expected to be helpful for our aging society and for people with psychiatric problems. However, the system has not been utilized well since its implementation by 1 July, 2013. Therefore, continuous studies about change of recognition to the adult guardianship, consideration of service costs, and public guardianship are necessary for the settlement and activation of the adult guardianship system.
