건설공사 품질관리의 제도적 개선 방안 : 건설기술진흥법을 중심으로 = Institutional improvement method of quality management in construction work : focusing mainly on the construction and technoligy promotion law

국문 초록 (Abstract)

국내 건설공사의 과도한 경쟁 및 품질관리에 대한 인식 부족 등으로 계속적인 대형 품질사고가 발생하고 있으며, 이에 대한 개선을 위하여 다양한 대책 및 제도 개선이 이루어지고 있으나, 건설공사의 품질향상은 크게 발전되지 않고 있는 것이 사실이다.
현재 건설공사 품질관리와 관련된 법규들을 보면 건축법, 건설산업기본법 및 건설기술진흥법(구. 건설기술관리법) 등이 있다. 특히, 건설기술진흥법의 경우 2013년 5월 22일 건설기술의 경쟁력을 강화하고 관련 산업의 발전을 도모하기 위하여 건설기술 관리체계를 규제 중심에서 관련 산업의 진흥과 지원 중심으로 전환하고, 세분화된 건설기술용역 업무 영역 및 건설기술인력 분야를 통합하여 국내 건설기술산업의 해외진출과 경쟁력 향상을 도모하기 위하여「건설기술관리법」을「건설기술진흥법」으로 전면 개정하는 등 다양한 분야의 경쟁력 강화와 제도 개선을 위하여 노력을 하고는 있으나, 건설업의 품질관리 개선을 위해서는 더 많은 제도의 개선이 필요하다.
이를 위해 본 연구에서는 현재 건설업의 품질관련 제도에 대한 현황을 알아보고 운영상 문제점과 개선방향을 제시하였다. 품질관련 제도들이 건설 품질관리 개선에 얼마나 효율적인지를 고민을 해 볼 필요가 있으며, 이를 위하여 관련 판례 및 외국사례 등을 조사·연구하여 개선방안을 도출하고 건설 품질관리의 제도개선을 유도하고자 한다.
개선방안으로는 품질관리에 대한 인식 제고를 위하여 건설기술자 경력 구분과 선임 등에 대한 방법을 개선하고 건설공사 부실측정 대상을 확대하며, 품질관리비의 현실화를 통하여 품질관리를 우선으로 하는 품질관리 문화를 정착하고자 한다. 또한, 현장에서 이루어지는 품질시험업무의 아웃소싱을 통하여 전문성 확보 및 품질시험 인력의 고용 안정성 증대에도 기여를 하고, 실질적인 품질관리계획 수립을 통한 품질관리 프로세스를 정착하고자 한다. 마지막으로 건설 품질관리에 대한 정부정책을 지원하고, 건설현장의 품질 선진화를 위한 지원과 D/B 구축을 통한 지속적인 개선을 주도할 수 있는 전문기관의 설립이 필요하며, 이런 제도적인 개선을 통하여 건설 품질관리의 선진화를 유도할 수 있다고 판단이 된다.

다국어 초록 (Multilingual Abstract)

Large scales of quality related incidents have been continuously occurred in the construction sector in Korea due to the lack of awareness of the importance of quality management and excessive competition in the concerned sectors. A variety of measures and institutional revisions have been implemented to improve these issues, but, it is widely accepted that significant quality enhancement in construction works has not been achieved.
Currently, laws and regulations on quality management for construction works are as follows: Acts on Building, Framework Act on The Construction Industry, and Promotion Act on Construction and Technology (Previously, Construction Technology Management Act).
In particular, as for Promotion Act on Construction and Technology, 「Construction Technology Management Act」 was fully revised into 「Promotion Act on Construction and Technology」 on May 22, 2013 with the aims of reinforcing the competitive edges of construction and engineering, and promoting the development of related industries. It also emphasizes on transition from regulating the management system of construction and engineering to supporting and promoting the concerned industries, and integrating segmentalized construction and engineering service areas, and its work forces to facilitate overseas expansion and competitiveness of domestic construction and engineering industry.
Even though huge efforts have been made to strengthen the competitiveness in various fields, the further improvement and modification of institutional frameworks are necessary for the development of quality management of construction and engineering sector.
To cater to this purpose, this study aimed to identify the current status of quality related regulations of construction sector and to present current issues and to suggest potential improvement measures. This paper will examine how efficient quality related laws and regulations are in terms of improving quality management of construction sector. It will draw upon the adequate improvement measures by surveying and researching relevant cases and international practices so that it would provide guidelines for institutional improvement of quality management of construction.
For improvement measures to heighten the awareness of the quality management, it seems necessary to revise thecriteria for career and qualification of construction engineers, expand the target for investigation on the defective construction works, and to make quality management cost realistic in order to achieve the ultimate goal of formulating the quality management oriented culture.
Also, it seems necessary to secure expertise by outsourcing quality and test, which is normally conducted at work sites, and contribute the stability of employment of quality and test workforces. Furthermore, quality management process would be settled by formulating practical quality management plans.
Finally, it seems necessary to support government policy on quality management of the construction sector, and advancement of quality at construction sites, implement DB, and establish dedicated agencies, which will initiate continuous improvement. With these institutional improvements, advancement of quality management of construction sector can be achieved.
