차별금지 관련 법률의 부정합성 = 인권위법과 개별적 차별금지법을 중심으로

국문 초록 (Abstract)

지난 4~5년 동안 우리 사회의 차별금지 관련 법제는 상당한 변화를 겪었다. 수차례 인권위법이 개정되었고, 장애인차별금지법 제정, 연령차별금지법 개정, 남녀고용평등법 개정 그리고 남녀차별금지법 폐지 등이 이루어졌다. 차별행위에 대한 피해구제는 인권위법의 평등권 침해행위 조항에 근거해 이루어지고 있으며, 장애, 연령, 남녀고용평등에 관한 개별적 차별금지법 역시 인권위에 차별피해를 진정할 수 있다. 차별시정기구의 일원화와 차별 관련 법률들의 제ㆍ개정이 진행되는 가운데 인권위법과 기 제정된 개별적 차별금지법 간에는 일정한 혼란과 불일치 그리고 차별피해구제의 사각지대 등 체계적 부정합성이 발견되고 있다. 이 논문은 인권위법과 개별적 차별금지법률들의 상호비교를 통해 차별사유에 대한 개념정의, 차별금지 적용 영역, 금지되는 차별의 유형, 차별시정기구 및 시정권한 그리고 제재규정 등에서 나타나는 문제점을 지적했다. 개별적 차별금지법에는 규정되어 있으나 가장 광범위한 차별금지사유를 명시한 인권위법은 간접차별을 규정하지 않고 있으며, 장애인차별금지법에 규정한 장애로 인한 괴롭힘은 인권위 진정 대상에서 배제되어 있고, 고용상의 성희롱은 피해구제에서의 차이를 발생시키기도 한다. 이러한 문제점들을 해결하기 위해 차별진정기구인 인권위의 근거법인 인권위법에 개별적 차별금지법의 법률 적용을 명시하는 방안, 개별적 차별금지법률의 개정을 통해 불일치를 해소하는 방안, 그리고 차별금지의 종합적이고 일관되며 체계적인 적용을 위해 일반적 차별금지법을 제정하는 방안 등을 제안했다.

다국어 초록 (Multilingual Abstract)

Anti-discrimination acts in Korea have gone through a great deal of changes for the recent few years. The National Human Rights Commission Act(NHRC Act) has been revised multiple times, and the Disability Discrimination Act has been enacted. The Age Discrimination Act and the Equal Employment between Genders Act have also been revised, while the Act Sex Discrimination has been abolished. Since we have no general Human Rights Act, individual actions of discrimination are regulated on the basis of the rights-to-equality clauses of the NHRC Act. Violations of other individual anti-discrimination acts regarding disabilities, age, or equal employment between genders can also be complained to the NHRC. While efforts to unify organizations for redresses of discriminations have been made, and related acts have been enacted or revised, there is incoherence, which have inconsistencies and confusions between the NHRC Act and other individual anti-discrimination acts and resulted in a variety of difficulties and blind spots in redressing violations. In this paper, I compare individual anti-discrimination acts with the NHRC Act, and points out a series of problems regarding, among others, the definitions of discrimination account, the scopes where the acts are applied, forms of discrimination prohibited by those acts, discrimination-redressing organizations and their jurisdictions, and provisions on restraints. Individual anti-discrimination acts stipulate indirect discriminations, while the NHRC Act, which is supposed to include broader categories of discrimination factors, does not. Harassment on the basis of disabilities is stipulated in the Prohibition of Discrimination against People with Disabilities Act, but not recognized as a complainable violation in the NHRC Act. And there are inconsistencies between those acts regrading, for example, redress for sexual harassments on the job. In order to solve these problems, I suggest that the NHRC Act stipulate that it is inclusive of other individual anti-discrimination acts, that each anti-discrimination act be revised to clear the existing inconsistencies, or that a general anti-discrimination act be enacted for more comprehensive, consistent, and systematic legal applications.
