美國憲法上 平等保護를 위한 司法審査

다국어 초록 (Multilingual Abstract)

The Equal Protection Clause under the Fourteenth Amendment in the U.S. Constitutional Law, adopted in 1868, was prescribed in order to abolish the discrimination of a black. It has become an important standard of judicial review for constitutional cases in the U. S. Supreme Court. The U.S. Supreme Court applied the rationality standard before the Warren Court, applying the two-tier approach and applied the three-tier approach since the Burger Court.
In equal protection cases, the Warren Court headed toward the judicial positivism and the Burger Court and the Rehnquist Court headed toward the judicial negativism. Also in the Roberts Court, constituted after the death of Chief Justice William Rehnquist it seems that the judicial restraint will be continued due to the conservative justices nominated by Bush.
