초등의무교육에 있어서의 아동 자유 제한의 정당성 연구 = The justification for the constraint of Children\ s Freedom in the Elementary Compulsory Education

국문 초록 (Abstract)

개인적⋅국가적 차원에서 교육의 목적을 달성하기 위하여 국가가 최소한으로 마련하고자 하는 의무교육은 기본적으로 교육받을 것을 의무적으로 강제하는 교육이기 때문에, 국민이 자유롭게 교육하고 교육받을 권리를 제한할 수 있다는 점에서, 의무교육과 아동 자유의 문제는 항상 교육적 논쟁이 되고 있다. 그러나 성인과 달리 아동 자유의 문제는 일반적인 의미로 논의될 수 없으며, 학교라는 특수한 학습 사태와 훈육 사태에서 논의될 필요가 있다. 초등의무교육은 본질적으로 아동 개개인에게 부합하도록 해야 하지만, 초등교육이 보편성과 공공성을 추구한다는 점에서 아동의 자유는 제한될 수밖에 없다. 아동이 적어도 그 사회에 적응하기 위한 최소한의 교육을 조건 없이 교육받아야 하는 인간 생존권과 아동 자신들에게 이익이 되고 그 내용이 도덕적으로 타당하다는 전제하에서는 최소한의 기초적인 초등교육을 제공하는 초등의무교육은 그 정당성을 확보할 수 있다.

다국어 초록 (Multilingual Abstract)

This study is concerned in the nature of elementary compulsory education and justification for the constraint of children\ s freedom in compulsory education through the matter of children\ s freedom in schooling. In elementary compulsory education, the claim that children should have the right to choose their own educational experiences is not valid in place of the schooling. Based on children who not able to judge what they will do in their lives, Teachers inevitably constrain or infringe children\ s freedom in schooling. In this point, it is possible to justify constrain children\ s freedom, and compulsory education should be made up of curriculum that can be interested to children and consisted of the basic minima. If not the basic minima, children will miss the opportunity to get possibilities to develop their full potential. So the constraint of children\ s freedom in elementary compulsory education can be justified not only because more beneficial to the children in the future, but also because nature of elementary compulsory education for children\ s welfare rights.
