양심적 병역거부와 대체복무제에 대한 법적 분석 외국의 입법례 및대체복무방안에 대한 반대의견 = A Study on the Law of Discrimination and Alternative Service in Korea

국문 초록 (Abstract)

양심적 병역 거부는 오래 전부터 있어왔던 사회의 문제였다. 양심적 병역 거부에 대한 문제를 그동안 국가에서는 위법으로 판단하여, 양심적 병역 기피자들에게 군 복무기간과 동일한 기간 동안의 징역을 선고하였다. 이에 따라 연간 천여명 정도가 병역 대신에 감옥을 택하고 있었다. 하지만 얼마 전 법원에서 지금까 지의 판례를 뒤엎고, 양심적 병역 거부자 세 명에 대해 무죄 판결이 내려졌다. 이판결은 단순한 사건의 판결을 넘어서 사회전반에 걸쳐 엄청난 파장을 일으키고 있다. 이는 우리나라 병역제도와 관련이 있는데, 우리나라는 미국과 같이 모병제를 하는 것이 아니라 강제징집에 따라 군인을 모집하기 때문이다. 사실 군대를 가는것, 특히 한창 일을 하고 공부를 해야 할 20대 초, 중반을 군대라는 울타리에 갇혀 2년이라는 긴 시간을 보내야 하기 때문에 더욱 더 파장이 크다. 양심적 병역 거부란 종교적인 신념 때문에 군대의 징집을 거부하는 행위를 말하는데 특정 종교단체의 신도들이 평화수호와 집총거부를 내세우면서 양심에 따라 병역을 거부하고 있다. 이는 개인의 종교적인 신념이 사회의 제도와 맞선 것으로 어느 것이 더 중요하다고 할 수 없지만 우리나라에서는 그동안 국가제도의 손을 들어주고 있었다. 그러나 이번 판결로 국가의 사법기관에서 개인의 손을 들어줌으로 해서 그동안 아무 말 없이 강제력에 호응하던 사람들이 다시금 들고 일어날 계기를 만들어 주었다. 사실 양심적 병역 거부자들의 주장을 한마디로 무시할 수는 없다. 특히 지금껏 양심적 병역 거부자들은 군대를 안가는 조건으로 징역을 택할 만큼 진심으로 자신의 양심에 따라 병역을 거부한 것이기 때문이다. 사실 군대를 안 간다고 해서 범죄자가 된다는 것은 억지스러운 면이 있기도 한것은 사실이다. 특히 요즘 세계적인 추세로도 양심적 병역 거부를 인정을 하고 있는 추세이기도 하다.

다국어 초록 (Multilingual Abstract)

A conscientious objector has long been a social problem. The issue of conscientious objectors has been considered illegal by the government, and conscientious objectors have been sentenced to prison terms for the same period as the military service period. As a result, about 1,000 people choose to go to jail instead of serving in the military. However, the court recently overturned the previous case and found three conscientious objectors not guilty. The ruling is causing a huge stir throughout society, beyond the judgment of a simple case. This is related to the nation s military service system, as the country recruits soldiers according to compulsory conscription, not conscription like the United States. In fact, it is all the more disturbing to go to the military, especially because you have to spend two years in the middle and in your early 20s stuck in a fence called the Army. A conscientious objector refers to the refusal of military conscription because of religious beliefs, where members of certain religious groups are refusing military service according to their conscience, advocating peacekeeping and refusing to hold a house. While this is not to say that it is more important that a person s religious beliefs are opposed to the system of society, it has been in support of the social system in Korea. The ruling, however, gave a hand to the nation s law enforcement agencies, creating an opportunity for those who have responded to the coercion to rise again. In fact, we cannot ignore the claims of conscientious objectors in a word. In particular, conscientious objectors have refused to serve in the military in accordance with their conscience, as they choose to serve in the military on the condition that they do not serve in the military. In fact, it is also farfetched to be a criminal if you don t go to the army. In particular, the global trend is to deny conscientious objection.
