드론 관련 범죄 예방을 위한 법제 연구 = Legal Research for Prevention of Drone-related Crime

다국어 초록 (Multilingual Abstract)

The purpose of this study is to examine the current administrative regulations and criminal law issues in accordance with the crime risk of drones, to discuss legislative discussions on the prevention of drone crimes, and to present theoretical basic data for future criminal policy alternatives. As a result of this, it is necessary to first introduce a real name registration agent for drones having a weight of 12 kg or less. And flying with a drone can be construed as a crime of obstructing interpretation work, obstructing general traffic and taking a picture using a camera. However, the crimes of invasion by drones and theft of drones are difficult to apply under the current law, and additional penalties must be reflected in the law. In addition, in case of drone shooting, it should be viewed as collection of personal information by image information processing device under the Personal Information Protection Act, and the restriction on collection and use of image information should be specified in detail. Furthermore, when collecting and utilizing video information by drone shooting, specific guidelines for processing restrictions on shooting and collecting information should be prepared so as not to infringe the rights of others.

국문 초록 (Abstract)

본 연구에서는 드론에 의한 범죄위험성에 따른 현행 행정규제 및 형사법 상 쟁점을 살펴봄과 동시에 드론 범죄를 예방하기 위한 입법론적 논의를 하고자 하며, 향후 형사정책적 대안을 위한 이론적 기초자료를 제시함을 목적으로 한다. 이에 따른 결과로서 먼저 자체중량 12㎏ 이하 드론에 대한 실명등록제가 도입될 필요가 있다. 그리고 드론에 의한 비행은 해석상 업무방해죄, 일반교통방해죄, 그리고 성폭력범죄의 처벌 등에 관한 특례법상 카메라 등을 이용한 촬영죄가 성립할 수 있다. 그러나 주거침입죄와 드론을 대상으로 한 사용절도죄는 현행법상 그 적용이 어려우며, 이에 대한 추가적인 벌칙조항을 관련법에 반영하여야 한다. 이와 더불어 드론에 의한 촬영의 경우 개인정보 보호법상 영상정보처리기기에 의한 개인정보 수집으로 볼 수 있어야 하며, 영상정보 수집과 활용에 대한 제한 규정을 구체적으로 명시하여야 한다. 또한 드론 촬영에 의해 영상정보를 수집하고 활용하는 경우 타인의 권리를 침해하는 정도에 이르지 않도록 촬영제한과 수집 정보에 대한 처리에 대한 구체적인 지침이 별도로 마련되어야 한다.
