칸트의 『법론』은 오랫동안 윤리학의 단순한 부록이나 홉스주의적 자연법학의 변형으로 오해받아 왔다. 본고는 이러한 오해를 불식하고, 『법론』 전체가 ‘초월적 자유’에서 출발하여 만국의 영구평화에 이르는 거대한 ‘초월적 연역’ 구조임을 밝힌다. 칸트에게 연역이란 형식논리학의 삼단논법적 추론이 아니라, 주어진 개념이나 원리가 어떤 권리로 객관적 타당성을 갖고 사용될 수 있는가를 선험적으로 입증하는 자격증명(quid iuris)이다. 본고는 이 연역이 세 단계의 요청(Postulat)을 통해 자유의 법칙을 새로운 경험적 대상 영역에 적용해 나가는 종합적 확장으로 전개됨을 논증한다. 제1 요청은 내적 자유의 법칙을 제한된 공간을 점유하는 이성적 존재자들 사이의 외적 관계로 확장하여 보편적 법원리와 강제 권한의 분석적 결합을 정초한다. 제2 요청은 보편적 법원리를 외적 대상에 대한 예지적 점유의 가능성으로 확장하여 가능성으로 확장하여 물권⋅대인권(채권)⋅물권적 대인권(가족법적 지위)의 사적 권리 체계를 산출한다. 제3 요청은 자연상태의 세 가지 규범적 결함-입법의 부재, 상호보증의 부재, 적용의 불확정성-을 극복하기 위해 전방적 의지에 의한 공법적 상태로의 이행을 의무로 정초한다. 이 과정을 통해 일방적 의지들의 충돌은 전방적 의지와 근원적 계약에 기초한 공적 제도를 통해 해소되며, 국가의 정당성 및 권력 분립을 갖춘 공화주의 헌정의 필연성이 도출된다. 각 단계에서 자유의 법칙은 새로운 부류의 경험적 조건에 적용되며, 이 적용은 순수 개념으로부터도 경험으로부터도 단독으로는 증명될 수 없기에 요청의 형태를 취한다. 본고는 이 연역 구조의 체계적 특성으로 선험적 요청을 통한 종합적 확장, 형식성의 일관된 유지, 그리고 이념과 현실의 이중적 관점을 제시한다. 결론적으로, 칸트 법이론은 법의 정당화가 궁극적으로 자유의 법칙과 이성적 존재자의 공간적 공존 사이의 종합에 의존한다는 것을 투명하게 드러내며, 철저한 형식성을 유지함으로써, 다원적 가치관을 지닌 현대 사회에서도 이성적 존재자들 간의 외적 자유가 공존할 수 있게 하는 원리적인 철학적 기초를 제공한다.

Kant’s Doctrine of Right (Rechtslehre) has long been misread as a mere appendix to his ethics or an imperfect variant of Hobbesian natural law theory. This article dispels such misunderstandings and demonstrates that the Rechtslehre constitutes a single, architectonic transcendental deduction-a chain of quid iuris justifications-extending from transcendental freedom to a cosmopolitan legal order of perpetual peace. For Kant, deduction is not syllogistic inference but the a priori justification that a given concept or principle may rightfully claim objective validity. The article argues that this deduction unfolds through three successive postulates (Postulate), each of which synthetically extends the law of freedom to a new domain of empirical conditions. The First Postulate extends inner freedom to the external relations among rational beings who occupy limited space, thereby grounding the Universal Principle of Right and the analytic unity of right and coercive authority. The Second Postulate extends the Universal Principle of Right to the possibility of intelligible possession (possessio noumenon) of external objects, generating the tripartite system of private right-rights in rem, rights in personam, and rights of domestic status. The Third Postulate overcomes the three normative defects of the state of nature-the absence of public legislation, of mutual assurance, and of authoritative adjudication-by grounding the duty to enter a juridical condition sustained by an omnilateral will. Through this process, conflicts among unilateral wills are resolved by public institutions founded on the omnilateral will and the idea of the original contract, yielding the necessity of a republican constitution with the separation of powers as the condition of legitimate statehood. At each stage, the law of freedom is applied to a new class of empirical conditions, and since this application can be demonstrated neither from pure concepts alone nor from experience alone, it takes the form of a postulate. The article identifies three systematic features of this deductive architecture: synthetic extension through a priori postulates, consistent formalism throughout every stage, and a dual perspective that holds the pure idea of the state in permanent tension with its inevitably defective empirical realizations. In conclusion, Kant’s legal philosophy transparently reveals that the justification of law ultimately rests on the synthesis between the law of freedom and the spatial coexistence of rational beings, and, by maintaining rigorous formalism, offers a principled philosophical foundation for the coexistence of external freedom among rational agents even in a modern society of pluralistic values.
