생산적 국회운영을 위한 대통령-국회 관계와 정당 = Productive Legislature and Presidential-Legislative Relationship in Korea

국문 초록 (Abstract)

민주화를 이루어낸 지 20년이 지났음에도 중요한 정치제도인 국회와 국회를 주요 무대로 활동하는 정당이 갈등해소와 사회통합이라는 본연의 역할을 제대로 수행해내지 못하고 정치적 교착과 파행이 반복되는 국회운영이 지속되고 있는 실정이다. 더욱이 문제는 이러한 파행적인 국회운영이 대통령의 소속 정당이 국회의 소수당인 분점정부일 경우뿐 아니라 대통령의 정당이 다수당인 단점정부에서도, 그리고 정당의 구조와 운영이 민주화된 최근에도 지속되고 있다는 점이다. 파행적인 국회운영을 생산적인 국회운영으로 전환시키는 일은 이제 민주주의의 공고화를 위해 더 이상 미룰 수 없는 과제이며 이를 위해서 시급한 것은 대통령-국회 관계가 재정립되는 일이다.
본 논문은 생산적인 국회운영을 이루어낼 수 있는 대통령-국회 관계를 모색하고 있으며, 대통령-국회 관계의 형성에 실질적으로 크게 영향을 미치는 정당을 중심으로 논의를 전개하고 있다. 이를 위하여 먼저 민주화 이후 파행적인 국회운영이 어떤 양상으로 나타나고 있으며 이를 야기하는 구조적 요인은 무엇인지를 살펴보고, 이어서 대통령제 민주주의에서 국회가 생산적으로 운영되기 위해서는 정당 및 의원들 간의 절충과 타협에 기초한 국회에서의 협력적인 정치가 왜 중요한지에 대해 논의하고 있다. 또한 이처럼 국회에서 협력적인 정치를 통한 생산적인 국회운영을 이루기 위하여 대통령-국회 관계 또는 대통령-국회 내 대통령의 소속 정당인 집권당 및 반대당과의 관계가 어떻게 변화되어야 하고, 이러한 변화를 가져오기 위해 어떠한 방안들이 고려될 수 있으며, 국회 내 정당과 국회 밖 정당간의 관계는 어떻게 설정되는 게 바람직한지 등을 다루고 있다.

다국어 초록 (Multilingual Abstract)

Although about 20 years have passed since the democratization of 1987, the Korean legislature and political parties have not yet played an expected role adequately by coordinating conflicting interests in the policy-making process. What is more, political paralysis and policy gridlock in the National Assembly have continued regardless of the Korean legislature dominated by either governing party or opposition party. We need a more constructive and cooperative presidential-legislative relations to have a more productive legislature, which is crucial for democratic consolidation in Korea.
Since the tense presidential-legislative relationship has mainly derived from the extra-parliamentary party organization controlled by either a charismatic party leader or a small number of party activists, it is necessary to have political party fit for a productive legislature by strengthening the autonomy of party organization within the legislature in policy-making and law-making process. It is also necessary to enhance the autonomy of individual legislators from extra-parliamentary party organization's constraints, thus activating deliberation among legislators. The autonomy of lawmakers in legislative process also allows them to vote across party lines and facilitates the activities of floor and committee meetings by building up flexible policy coalitions among parties as well as lawmakers within the legislature, thus making it possible to coordinate conflicting interests in the policy-making process.
