메타버스 플랫폼의 준거법 약관과 국제재판관할권에 관한 연구 – 미국의 사례를 중심으로 - = Study on the Metaverse Platform's Governing Law Terms of Service and International Jurisdiction - Focusing on U.S Cases -

국문 초록 (Abstract)

메타버스는 인터넷을 뒤이을 차세대 플랫폼으로 손꼽히고 있다. 메타버스는 우리의 일상생활에 적지 않은 영향을 줄 것이며, 현실세계와 가상세계의 구분을 모호하게 할 것이다. 이는 향후 메타버스에서 다양한 법적 분쟁이 발생할 수 있다는 의미를 뜻하기도 한다. 특히 메타버스의 초국경적 특성으로 인해 분쟁이 발생하였을 때 준거법 및 재판관할 지정의 문제에 당면할 수 있을 것인바, 이에 본고에서는 현재의 메타버스 플랫폼의 이용약관을 살펴보고, 재판관할을 중심으로 미국의 사례들을 살펴보고자 한다. 이를 알아보기 위해 미국의 일반적인 재판관할 법리를 살피고, 인터넷공간에서의 재판관할 법리를 통해 이러한 법리가 메타버스 플랫폼 관련 분쟁에 어떻게 적용되는지 사례를 살펴보면서 이해하고자 하였다. 아직 메타버스 관련 사례가 많이 집적되어 있지 않아 리딩케이스나 정리된 이론이 존재하지 않기 때문에, 추후 관련 분쟁이 급증하였을 때 보다 정리된 재판관할 법리가 필요해 보인다.

다국어 초록 (Multilingual Abstract)

Metaverse is regarded as a next-generation platform succeeding the Internet. Metaverse will have a significant impact on our daily lives and will blur the distinction between the real world and virtual world. This also means that various legal disputes may arise in the metaverse in the future. In particular, the transnational nature of the metaverse may raise issues of the governing law and jurisdiction in the event of a dispute, so this article will examine the current terms and conditions of the metaverse platform, with a focus on jurisdiction in the United States. In order to explore the above, this article will introduce the general jurisdictional law of the United States and the jurisdictional law regarding the Internet, and then examine how these laws could apply to disputes arising from the metaverse platform. As there are not yet many metaverse-related cases, and therefore, no leading case or theory has been established, a unified jurisprudence shall be needed for future metaverse-related disputes to come.
