소년수형자 교정처우 개선방안에 관한 연구 = A Study on Policy Improvement for juvenile convicts correction and Treatment

다국어 초록 (Multilingual Abstract)

There are two main reasons why it is significant to contemplate on conviction of Juvenile Delinquents. First, these Juvenile Delinquents will be the future leaders of society. Second, crimes committed by them would escalate into adult crimes, if not monitored. Therefore, we do not only have to make preventive measures effectively but also taking into consideration their societal roles in the future. If we are laying out plans regarding crimes convicted by juvenile delinquents, then we must recognize that it is from an immature society where it sprang from. These
tendencies are showed through expanding protective measures which pursue protection rather than punishment for crimes committed by Juvenile Delinquents. More systematic and welfare-oriented measures are requested for prevention of these crimes and also for the second conviction of the Juvenile Delinquents.
In order to obtain remedy and edification effect, I am going to further study the reasons of juvenile delinquency, juvenile delinquents’ tendencies, actual conditions of remedy for juvenile delinquent convicts, programs for juvenile delinquent convicts and problems concerning proper welfare-oriented approaches.

국문 초록 (Abstract)

소년수형자에 대한 연구가 사회적으로 중요한 의미를 갖는 것은 청소년이 국가의 장래를 책임져야 할 사회적 책무를 진다는 사실과 청소년범죄가 성인범죄로 발전할 가능성이 높다는 사실 때문이다. 따라서 청소년범죄에 대해서는 효과적인 예방대책이 강구되어야 할 뿐 아니라 청소년범죄가 발생하였을 경우에 장래 청소년의 사회적 역할을 감안한 처리방안이 마련되어야 할 것이다. 또한 청소년범죄에 대한 대책을 수립함에 있어서는 그들의 범죄가 주로 사회적 미성숙에서 비롯된다는 점을 고려해야 할 것이다. 이러한 점은 실제로 범죄청소년에 대한 대책 수립에서 처벌보다 보호를 우선적으로 고려하는 보호처분의 확대실시를 통해서 나타나고 있다. 따라서 보다 체계적이고 복지적 차원의 청소년범죄의 예방과 소년 수형자의 재범방지를 위한 형사사법적 대책의 마련이 요구되어지고 있다.
여기서는 소년수형자의 교정복지적 관점에서 청소년범죄의 사회적 원인을 알아보고 우리나라의 현행 교정 처우실태 및 프로그램의 현황과 문제점을 파악하고 그에 따르는 개선방안을 제시하여 효율적인 교정･교화의 효과에 기대를 걸고자 하는데 있다 하겠다.
