미국 행정법상 금지명령의 요건 = The necessary requirements for Injunctions in the U.S. Administrative Law

국문 초록 (Abstract)

현행 행정소송법은 항고소송을 취소소송, 무효 등 확인소송, 부작위위법확인소송의 세 종류로 규정하고 있다. 이러한 제한적인 항고소송 방식으로 인하여 국민의 생존권과 권리보호에 미흡하다 는 지적이 지속적으로 진행되어 오고 있다. 행정이 복잡해지고 다양화됨에 따라 전통적인 항고소송만으로는 국민의 권리구제와 행정통제 에 실질적인 효력을 기대할 수 없으므로 다양한 소송방식제도의 채택은 시급하다. 우리 행정소송 법 개정안에서도 이러한 문제점에 대한 인식하에서 의무이행소송과 예방적 금지소송을 도입하려고 하였다. 또한 가명령제도의 도입도 고려하고 있었다. 좀 더 다양한 소송방식제도의 연구가 시급한 시점에서 미국의 금지명령제도는 우리에게 시사해 주는 바가 있어 이에 대한 발령요건들을 살펴보고자 하였다. 미국의 금지명령은 예방적인 기능, 보상적인 기능, 구조적인 기능을 해오고 있다. 금지명령은 금지적 금지명령으로 피고의 불법행위로 위협받는 장래 손해발생행위를 금지하도록 함으로써 예방 적인 기능을 하고 있으며, 이행적 금지명령으로 과거 행위로부터 발생하는 미래의 손해를 예방하고 원고에게 권한이 부여되었던 이전의 상황을 원고에게 원상회복시켜줌으로써 보상적인 기능을 해오고 있고, 드물지만 더 나아가 심각하게 스며드는 권리 위반행위에 대해서는 이행적 금지명령을 내리면서 헌법적 요구에 부합하도록 사회적 또는 정책적 제도를 개선하도록 주문할 수 있게 하 는 일반 법률의 구제수단으로 사용되고 있다. 따라서 행정청의 권한· 의무의 존재가 일의적으로 명백하고, 권리보호의 필요성이 명확하여 사후에 처분의 효력을 다투는 것으로는 회복하기 어려운 중대한 손해를 입을 우려가 있어 사전구제를 인정하지 않는 것이 현저히 상당하지 않은 특별한 사정이 있으며, 다른 구제방법이 없을 것을 요건으로 예외적· 보충적으로 인정할 필요가 있다. 이는 처분이 있기 이전이나 이후에도 피고의 불법행위가 지속적으로 진행될 가능성이 있거나 위협이 존재하여 장래 원고에게 회복하기 어려운 중 대한 손해를 입힐 위험성이 존재한다면 인정될 수 있을 것이다.

다국어 초록 (Multilingual Abstract)

An injunction is a court order requiring a person to do or cease doing a specific action. Temporary restraining orders and preliminary injunctions are temporary injunctions. They are issued early in a lawsuit to maintain the status quo by preventing a defendant from becoming insolvent or to stop the defendant from continuing his or her allegedly harmful actions. Choosing whether to grant temporary injunctive relief is a discretionary power of the court. Permanent injunctions are issued as a final judgment in a case. Failure to comply with an injunction may result in being held in contempt of court. An injunction is an extraordinary remedy that courts utilize in special cases where preservation of the status quo or taking some specific action is required in order to prevent possible injustice. Injunctive relief is a discretionary power of the court in which the court, upon deciding that the plaintiff`s rights are being violated, balances the irreparablility of injuries and inadequacy of damages if an injunction were not granted against the damages that granting an injunction would cause. When trying to synthesize like this points and our administrative lawsuit, does not accomplish all the role in right relief of the citizen. Also controlling an administrative right cannot accoplish all the role. Consequently, If Judiciary does not change in future, it is going to be extremely difficult troubleshooting. The Supreme Court administrative lawsuit legal revised bill which is propelled problem because like these to our administrative lawsuit development and stepping forward. But revised bill still was abolished in National Assembly and executions are still indefinite. But; When our administrative lawsuit goes with what kind of direction, the role as the mileage ticket does about. There are to like this changes, the Injunctions of the United States grow suggests.
