유럽에서 주거권 보장 = A Study on the Housing Rights in Europe

국문 초록 (Abstract)

이 논문은 유럽에서 다루어지고 있는 주거권 보장을 검토하고자 한다. 구체적으로는, ① 인권과 기본자유의 보호에 관한 유럽협약(The European Convention for the Protection of Human Rights and Fundamental Freedoms), ② 유럽연합 사회헌장(The European Union’s Revised Social Charter of 1996), ③ 유럽연합의 기본권 헌장(The Charter of Fundamental Rights of the European Union)에서 규정된 주거권의 의미를 분석하고자 한다. 또한 이 글에서는 유럽인권재판소(The European Court of Human Rights)와 유럽사회권규약위원회(The European Committee of Social Rights)에서 논의된 주거권 보장과 관련된 내용을 다루고자한다.
주거권은 사회권 보장에서 중요한 의미를 지닌다. 주거권은 세계인권 선언 제25조에서 규정된 이후, 국제사회에서도 중요한 권리로 인식되고 있다. 이후로도 인간의 존엄성에 근거한 주거권의 개념은 발전되어 왔다. 주거권은 유럽인권보장체제에서 기본적인 권리로 보장되고 있다. 유럽연합에서 논의된 주거권의 개념을 분석하면 아래와 같다.
첫째, 인권과 기본자유의 보호에 관한 유럽협약에는 주거권이 직접 규정하고는 있지는 않지만, 비인간적인 처우 금지(제3조) 또는 사생활과 가족생활을 존중받을 권리(제8조)를 통해서 주거권의 의미를 설명하고 있다. 유럽인권재판소도 주거권을 인정하는 결정들을 내리고 있다.
둘째, 1996년 개정된 유럽연합 사회헌장의 제31조에서는 주거권을 다음과 같이 규정하고 있다. 회원국은 적절한 수준의 주택(Adequate Standard Housing)이 갖추어진 주거에 대한 권리를 보장하며, 노숙을 방지하고, 저소득층에게 부담 가능한 주택을 공급해야 한다고 규정하고 있다. 유럽연합 사회헌장에서는 사회권의 이행감시기구로 유럽사회권위원회를 두고 있다. 유럽연합사회권위원회는 당사국이 사회주택의 공급, 주거비 보조제도의 시행, 사법구제의 마련, 노숙인에 대한 긴급주택제공과 같은 주거 복지정책이 회원국 내에서 적절하게 집행되고 있는지를 평가한다.
셋째, 유럽연합의 기본권 헌장 제34조에서는 아래와 같은 내용을 담은 사회권 보장과 주택의 지원(Right to social and housing assistance)을 규정하고 있다. 유럽연합은 유럽연합법과 국내법에 따라서 사회적 배제와 빈곤 퇴치를 위한 목적으로 자원이 부족한 사람들에게는 사회권 보장과 주택 지원을 증진해야 한다고 규정되어 있다.
유럽연합에서는 국내법과 지침에 근거한 주거권 실현을 당사국의 의무로 인식하고 있다. 대부분의 유럽연합국은 주거권을 법적인 권리로 인식하고 있으며, 적절한 주거권을 보장하기 위한 다양한 노력을 하고 있다.

다국어 초록 (Multilingual Abstract)

The article analyses the right to housing in the context of the European Convention for the Protection of Human Rights and Fundamental Freedoms the European Social Charter and the jurisprudence of its monitoring institution the European Court of Human Rights and the European Committee of Social Rights.
The right to housing is no doubt one of the most crucial social rights closely connected to the right to life and other civil, political and economic, social rights and freedoms. The right to housing was recognized already in Article 25 of the first international human rights instrument, the Universal Declaration of Human Rights.
While there is no European Convention for the Protection of Human Rights and Fundamental Freedoms obligation for a universal provision of housing by the State, a combination of obligations under Articles 3 on State obligations to prevent inhuman and degrading treatment, and Article 8, on State respect for privacy, home and family life, are creating some legally defined minimum State obligations.
The European Union’s Revised Social Charter of 1996 devotes a complete article to the right to housing, requiring parties to undertake measures that promote access to housing of an adequate standard, prevent homelessness, and ensure that housing is affordable for low-income individuals. The Revised European Social Charter has provided an important context for advancing claims related to the progressive realization of the right to housing. Article 31 of the Revised Charter requires States to undertake positive measures to promote access to adequate housing in order to prevent and reduce homelessness and to ensure affordable housing for low-income households. The European Committee on Social Rights interpreted Article 31, defining fundamental notions, such as adequate housing, homeless persons, forced eviction and housing affordability.
The Charter of Fundamental Rights of the European Union enshrines certain political, social, and economic rights for European Union (EU) citizens and residents into EU law. A legalization of the EU Charter of Fundamental Rights has clearly set in motion a process at the end of which the housing rights have been acknowledged as a part of the EU founding treaties. Charter contains a “right to social and housing assistance” thus integrating a right to housing assistance into EU law, regulation and policy. Since EU law is binding on the institutions of the Union, and Member States when they are implementing EU law, these housing rights obligations will now apply alongside any national obligations and standards. Most of the EU countries regard housing as a human right and respond to the challenge of the many aspects of inadequate housing.
