미국 무역위원회에서의 무역분쟁 사건처리의 쟁점과 우리 법제에 대한 시사점 - LG화학 vs. SK이노베이션 및 대웅제약 vs. 메디톡스 사건을 중심으로 - = Legal Issues on the USITC case management system and its implication to our legal system

Both LG Chem v. SK Innovation case and the Medytox v Daewoong Pharmaceutical case were cases in which domestic companies proceeded with intellectual property infringement cases in the United States at the US International Trade Commission (USITC). Regarding the awareness of the question of why the US Trade Commission, rather than the Korean courts or the Korean Trade Commission, should handle disputes between Korean domestic companies, this paper summarizes and derives the suggestions by the analysis of two cases. By reviewing the cases resolved by the US International Trade Commission, LG Chem v. The SK Innovation case and the Medytox v Daewoong Pharmaceutical case shows us a number of points we have to make for the betterment of the our legal system in terms of the procedural rules.
As a result of the analysis, the fact that the US market was important to the companies in the two target cases is not something that we can solve by improving the legal system. Although the courts and the Trade Commission are not inferior to the US Trade Commission in terms of the processing speed, there are differences in evidence discovery system. To make KTC more attractive jurisdiction, evidence investigation system needs to be supplemented through legislation. Another difference between Korea and the US is the sanctions against obstruction of evidence, so it was considered necessary to supplement the sanctions against obstruction of evidences in the case of unfair trade practices, including infringement of trade secrets and other intellectual properties. Lastly, there is a need to supplement the protective order in the case of trade secret infringement. Currently, there is a protective order system in case of infringement of trade secrets, but several problems are revealed in practice in the operation of the current system, so it is necessary to supplement it.

국문 초록 (Abstract)

LG화학 vs. SK이노베이션 사건과 메디톡스 vs. 대웅제약 사건은 모두 국내기업들이 미국에서 지식재산권 침해사건을 미국 무역위원회(ITC, International Trade Commission)에서 진행한 사건이다. 필자는 국내기업들간의 분쟁을 함에 있어서 왜 우리나라 법원이나 무역위원회가 아닌 미국무역위원회에서 사건을 진행할까에 하는 의문을 있었다. 이런 문제의식에 대해서 필자는 본고에서 미국무역위원회의 사건처리절차를 정리하고 LG화학 vs. SK이노베이션 사건과 메디톡스 vs. 대웅제약 사건을 분석하여 제시하였다.
미국시장이 이들 사건의 회사들에게 중요했다는 점은 우리가 제도개선을 한다고 해서 해소할 수 있는 것이 아니라는 점에서 제도개선을 통해서 할 수 있는 일을 생각하여 보았다. 신속한 분쟁해결이라는 점에서 우리 법원이나 무역위원회가 미국무역위원회에 비해서 열위에 있지는 않지만 증거조사에 대해서는 차이가 있고 입법을 통해서 증거조사제도를 보완할 필요가 있다고 보았다. 우리와 미국의 또 다른 차이는 입증방해에 대한 제재에 있으므로 영업비밀침해를 포함한 불공정무역행위가 있을 경우 이런 입증방해에 대한 제재를 보완할 필요가 있다고 보았다. 마지막으로 비밀유지명령의 보완 필요성도 있다고 본다. 현재도 영업비밀침해의 경우 비밀유지명령(protective order)제도가 있으나 비밀유지명령제도의 운용에 있어서 실무상 여러 문제점이 드러나고 있어서 이를 보완할 필요성이 있다고 본다.
