‘종교차별’에서 ‘종교이해’로의 패러다임 전환: 종교와 법의 관계성을 중심으로 = A Paradigm Shift from ‘Religious Discrimination’ to ‘Understanding Religion’: Focusing on the Relationship between Religion and Law

국문 초록 (Abstract)

법은 종교와 긴밀한 관계를 맺고 종교의 자유와 국교의 문제를 결정한다. 개신교가 국교인 영국에서 하원의원들은 자신의 종교와 신념에 따라서 경전을 들거나 거부하며 선언식을 하지만, 북한은 주체사상과 김일성-김정일주의를 근거로 신앙의 자유를 극도로 제한한다. 대한민국은 종교의 자유를 폭넓게 인정하면서 종교차별을 예방하기 위하여 공직자를 대상으로 종교차별예방교육을 실시해 왔다.
본 논문은 종교와 법의 관계성을 중심으로 종교차별의 문제를 종교이해의 방법으로 해결하기 위하여, 먼저 북한의 종교상황과 유일적영도체계확립의 10대원칙을 살펴보고, 둘째로, 중국에서 진행되고 있는 종교의 중국화와 파룬궁에 대한 차별 사례를 검토하고, 끝으로 2010년부터 진행되고 있는 한국 정부의 종교차별예방교육의 특징과 한계 및 앞으로의 발전을 위한 새로운 방향을 제안할 것이다.

다국어 초록 (Multilingual Abstract)

The law establishes close ties with religion and determines religious freedom and matters of state religion. In Britain, where Protestantism is the state religion, MPs hold declarative ceremonies by holding or rejecting scriptures according to their religion and beliefs, but North Korea severely restricts freedom of faith based on the Juche ideology and Kim Il-sung-Kim Jong-ilism. South Korea has widely recognized religious freedom and has provided education to public officials to prevent religious discrimination.
In order to solve the problem of religious discrimination through religious understanding, focusing on the relationship between religion and law, this paper will first examine the religious situation in North Korea and the ten principles of establishing a unique leadership system, secondly review the cases of religious Chineseization and discrimination against Falun Gong in China, and finally propose new directions for future development and the characteristics and limitations of the Korean government’s religious discrimination prevention education, which has been in full swing since 2010.
