체육인공제회 도입을 위한 법･제도적 연구 - ｢체육인복지법｣ 및 ｢체육인공제회법(안)｣을 중심으로 -

국문 초록 (Abstract)

이 연구는 ｢체육인복지법｣에 따른 체육인을 위한 보험 또는 공제의 가입을 통해 체육인의 생활안정을 도모할 수 있도록 체육인공제회 설립‧운영에 관한 사항을 검토하는데 그 목적이 있다. ｢체육인복지법｣은 체육인에 대한 복지정책의 수립과 체육인 복지를 위한 제도적 기반을 마련함으로써 체육인들의 생활안정과 체육활동 증진에 이바지함을 목적으로 제정되었다. “체육인공제회”는 상호부조의 공제이념에 따라 따른 공제급여나 연금 등을 통하여 체육인의 생활안정과 복지증진을 도모하여야 하는 체육인복지사업 중 가장 중요한 사업이다. 그럼에도 불구하고 현행 ｢체육인복지법｣ 제9조에 따른 보험 도는 공제의 가입에 관한 규정이 운동경기대회에 참가하는 선수의 보호 중심으로 되어 있어 체육인들의 생활안정을 위한 상호부조를 통한 공제사업 등이 제대로 추진되고 있지 못하는 한계 등이 있다. 이 연구는 질적연구를 바탕으로 타 법률에 따른 공제회 설립‧운영 등에 관한 선행연구 등을 분석하고, 공제외와 관련된 유사입법례 등의 분석으로 통해 개선방안을 도출하였다. 이에 따라 도출된 연구결과는 다음과 같다. 첫째, ｢체육인복지법｣의 개정을 통해 체육인의 생활안정을 위한 상호부조의 공제사업 근거 마련 둘째, 체육인공제사업의 적용 대상 확대 셋째, ｢체육인공제회법｣ 제정 및 ｢체육인복지법｣ 개정을 통한 체육인공제회 설립 등의 검토를 통해 수요자인 체육인을 위한 효율적인 공제제도를 확립하고 이를 통해 체육인의 생활안정과 복지증진을 도모할 수 있는 방안의 마련이 필요하다.

This study examines the establishment and operation of the Athletes' Mutual Aid Society, which aims to promote the livelihood security of athletes through insurance and deductions in accordance with the Athletes' Welfare Act. The Athletes' Welfare Act was enacted to establish welfare policies and an institutional foundation for athletes, thereby promoting their livelihood security and sports activities.
The Athletes' Mutual Aid Association is the Athletes' Welfare Program's most important project, which aims to promote athletes' livelihoods and welfare through deductible benefits and pensions in accordance with the concept of mutual aid. However, the current regulations on insurance and deductions under Article 9 of the Athletes' Welfare Act focus on protecting athletes participating in competitions.
Therefore, mutual aid and deduction projects to promote athletes' financial stability are not being properly promoted. Based on qualitative research, this study analyzed prior studies on the establishment and operation of mutual aid societies under other laws and derived improvement measures by analyzing similar legislative cases related to non-mutual aid.
The results of the study are as follows: First, establish a basis for a mutual aid deduction project to stabilize athletes' lives by revising the Athletes' Welfare Act. Second, expand the scope of the Athletes' Deduction Project. Third, establish an Athletes' Deduction Association by enacting the Athletes' Deduction Association Act and revising the Athletes' Welfare Act.
