불공정거래행위와 자율규제 = Unfair trading practices and self-regulation

국문 초록 (Abstract)

‘두려움 요소’와 같은 불공정거래행위의 특수성을 감안할 때, 공정거래문화 토양을확립할 수 있는 자율규제는 의미가 크다. 그런데 자율규제는 장단점이 뚜렷하고 자율성과 실효성에서 상충을 일으키기 쉽다. 특히 실효성 추구라는 명목하에 자율규제의본질인 자율성이 훼손되지 않도록 주시할 필요가 있다. 본문에서는 불공정거래행위 자율규제를, 정부가 주도하여 특정 분야의 주요 사업자를 선정하고 정부가 이들의 자율규제 이행안 결정과 평가에 관여하는 ‘하향식 자율규제’와, 정부가 자율규제에 직접 관여하지 아니하고 거래당사자들이 폭넓게 참여하는 ‘상향식 자율규제’로 나누고, 우리나라에서 실행중인 ‘플랫폼 민간 자율기구’의 갑을 분과 자율규제방안과 EU의 Supply Chain Initiative의 장단점을 비교, 분석하였다.
자율규제는 법적규제의 신설을 검토하는 과정에서 부상하는 경향이 있기는 하지만, 자율규제는 법적규제의 신설을 피하기 위한 방어수단이 본질은 아니기 때문에, 양자의운명을 서로 지나치게 연계하는 것은 바람직하지 않다. 즉, 법적규제의 대안으로 자율규제가 논의되더라도, 새로운 법적규제가 적절하고 현재 필요한 것인가에 대한 고민은계속되어야 한다. 요컨대 자율규제가 이미 행하여지고 있다고 하여 행정규제가 불필요하거나 줄어들어야 한다는 결론에 직결되는 것은 아니고, 반대로 자율규제의 실효성이생각보다 적다고 하여 바로 새로운 행정규제의 신설이 정당화되는 것도 아니라고 본다.

다국어 초록 (Multilingual Abstract)

Considering the characteristics of unfair trading practices such as ‘fear factor’, self-regulation changing unfair practices culture is significant. Self-regulation has two element: autonomy and effectiveness, often in conflict with each other.
However, its autonomy should be constantly ensured and not be damaged in pursuing effectiveness. This article compare top-down self-regulation, a form in which the government takes the lead in self-regulation, bottom up selfregulation, a form in which the government is not directly involved.
Self-regulation tends to emerge when lawmakers consider adding a new special regulation. But since self-regulation isn’t a means of defense to avoid and disturb new legislation, it is not desirable to excessively link the destiny of the two with each other. In other words, even if self-regulation is discussed as an alternative to a special legislation, concerns about whether new legislation is appropriate must continue.
