언론 윤리 가치의 위계 = hierarchical order of ethical values in journalisim?

국문 초록 (Abstract)

윤리는 대부분 윤리적 딜레마의 문제다. 윤리적 딜레마는 각각 윤리적으로 정당한 두 개 이상의 행위 중 하나를 선택해야 할 경우에 발생한다. 언론 활동에서 부딪히는 윤리적 문제를 해결하기 위한 모델로 ‘포터 박스’, ‘SAD 모델’ 등이 제시되고 있지만, 이 모델들이 윤리적 결정을 보다 합리적으로 할 수 있는 틀을 제공하지만, 어떤 윤리 이론을 적용해서 어떤 윤리적 가치를 선택해야 할 것인가의 딜레마를 해결해 주지는 않는다. 이 논문은 윤리이론 중 가치 이론을 원용해서 언론 윤리적 문제를 해결하는 데 있어 우선되는 가치가 있는가를 모색하기 위한 것이다. 가치이론에 따르면, 가치들은 위계질서가 있다. 즉, 가치들 중에는 높은 가치와 낮은 가치가 있다. 그러나 이러한 위계질서는 다차원적이기 때문에 모든 윤리적 문제에서 절대적으로 우위를 차지하는 가치를 특정하기는 힘들다. 그럼에도 불구하고, 이 논문에서는 언론 활동이라는 특수한 상황에서 다른 가치에 비해 상대적으로 우선되는 가치를 제안할 수 있고, 이 가치가 모든 상황에서 항성 우선되는 것은 아니지만, 언론 윤리의 문제에서 우선 고려될 수 있다고 주장한다. 그러한 가치를 도출하기 위해 이 논문은 언론을 활동의 맥락, 사회적 기능의 맥락, 목표의 맥락으로 구분하고, 각 맥락에서 우선되어야 할 가치로 각각 ‘진실성’, ‘공표’, ‘자유’를 제안했다. 언론 활동은 커뮤니케이션 활동이다. 커뮤니케이션에서 가장 기초적인 가치는 ‘진실성’이다. 진실성은 진실 자체와는 다른 것으로, 상대방이 진실을 알기 원하는 태도를 말한다. 진실성 혹은 ‘진실의 추구’는 정확성, 진정성, 투명성, 신중성 등의 원칙을 통해 달성될 수 있다. 언론의 기능은 사회의 자기 관찰로, 언론은 인지된 사실을 독자와 시청자에게 알려야 한다. 따라서 획득한 정보를 국익이나 기타 사회에 해를 끼칠 수 있다는 이유 등으로 억제해서는 안되며 ‘공표’ 혹은 ‘보도’해야 한다. 언론의 목표는 독자와 시청자가 자유롭고 스스로 주인이 되는 데 필요한 정보를 제공하는 것이다. 즉, 시민의 자유가 언론의 기본 목표이다. 언론사가 옳다고 생각하는 방향으로 시민들을 설득하기 위해 특정한 정보를 선택해서 제공하는 한국 신문들의 관행은 시민의 자유라는 언론 윤리의 우선 가치에 위배되는 행위이다. 진실성, 공표, 자유가 언론 윤리 문제에서 절대 적으로 우선되는 가치는 아닐 것이다. 적어도 ‘공표’라는 가치가 그렇 다. 그러나 이러한 우선되는 가치에 대한 인식은 다양한 가치가 개입된 윤리적 딜레마 상황에서 보다 안정적이고 방어할 수 있는 윤리적 결정을 내리는 데 도움을 줄 수 있다.

다국어 초록 (Multilingual Abstract)

Ethical problems constitute mostly ethical dilemmas. Ethical dilemmas occur when conflicts arise between two or more indispensable and defensible moral obligations. In many ethical problems in journalism there is no predetermined correct answer. Models for solving ethical problems, such as the “Potter Box” or the “SAD formula”, are useful by making a systematic approach. However they cannot eliminate the problem of “correct” weighing of competing values. This paper asks whether there is a hieratical order of values in journalism. Following ‘theories of values’ there is something like a rank of values. Some values can be regarded as higher than other values. But it doesn’t mean that in conflicts of values a specific value can have an absolute dominant position. But we can argue that some values could be preferred than others. This paper suggests three values which can be preferred in reasoning of ethical problems in journalism: truthfulness, disclosure, and freedom. With regard to the action of journalism, i.e. communication, the essential value is the truthfulness. Truthfulness is the basic condition of communication itself. Truthfulness is the attitude and endeavors of speaker that listener might learn the truth. Truthfulness can be accomplished by means of sincerity, accuracy, and carefulness. In the aspect of the function of journalism the primary value of journalism is disclosure. The basic function of journalism, as a subsystem of the society, is the observation of the society. The journalism system should let the members of the society know what it has watched. In principle it should not suppress any information obtained. Worry about national interest, consideration that some information could harm the social integration etc. should not be the first concern of the journalists. In respect of purpose of journalism the freedom of the citizens is the basic value, as B. Kovach and T. Rosenstiel conclude in their book ‘The Elements of Journalism’: “The primary purpose of journalism is to provide citizens with the information they need to be free and self-governing.” The practice of many Korean newspapers, providing with certain information which helps to persuade readers to follow viewpoints of the newspapers conforms by no means to this value. The three values cannot be applied in all cases of ethical problems as the absolutely prevailing values. But in cases in which the weighing of values is very difficult they can be useful by making a deliberated ethical judgment and –after it has been made-defending it.
