다문화주의와 인권의 상호보완성과 갈등성: 영국 이슬람공동체에 관한 일 고찰 = The Complementary and Conflictual Relationships between Multiculturalism and Human Rights: With Special Focus on the British Muslim Community

다국어 초록 (Multilingual Abstract)

This article discusses the question of multiculturalism and human rights within the British Muslim community. Multiculturalism has been justified by the cultural rights as part of human rights. Seen in this way, this article argues that there exists the Janus-faced relations of mutual complementarity and conflict between multiculturalism and human rights. Both communitarian and liberal perspectives on multiculturalism and each other's position on human rights have been introduced and discussed in this article. While communitarian perspectives of Stuart Hall and Bhikhu Parekh put central emphasis on a communitarian aspect of culture, liberal perspectives of Will Kymlica and Brian Barry put more emphasis on liberal values including individual freedom. Given these two contrasted perspectives, this article points out that the communitarian perspective on multiculturalism has the potential limitation of ignoring the individual freedom of members of multicultural community. Thus, this article claims that liberal perspectives on multiculturalism needs to be promoted to properly protect the fundamental freedoms of individual members of multicultural community. This claim is made against the human rights violations of Muslim culture including patriarchal honor killings. On the basis of the theoretical discussion, this article provides a case study of recent British Muslim community in terms of multiculturalism and human rights. British Muslim community is drawing attention in relation to its young people's violence and British governmental counter acts on it. Looking at the example of British Muslim community, it is important to approach multiculturalism from the liberal perspective so that individual persons' basic freedom should be respected while cultural rights of ethnic communities are protected.

국문 초록 (Abstract)

이 논문은 다문화주의 담론 속에서 인권의 문제를 영국의 무슬림소수자 공동체를 사례로 논의하고 있다. 다문화주의는 기본적으로 인권의 내용 중 문화권이라는 개념으로부터 정당화되고 있다. 이렇게 볼 때 다문화주의와 인권은 기본적으로 상호 보완성과 갈등성을 띤다. 따라서 이 문제의 논의를 위해 다문화주의에 대한 공동체주의적 시각과 자유주의적 시각 그리고 이러한 시각들이 인권에 대하여 어떻게 관련되는지를 검토하였다. 즉, 스튜어트 홀이나 비쿠 파레크 등의 공동체주의적 시각은 문화의 공동체주의적 특성을 강조한다는 점에서 다문화주의를 통한 소수자 문화공동체의 보호와 증진에 중요한 이론적 기초를 제공하고 있다. 그럼에도 불구하고 공동체를 강조하는 대신 그 공동체의 구성원으로서 개인들의 위상에 대해서는 등한시하거나 애매모호한 입장을 취하는 경향이 있어서 어떤 공동체 내의 관습이 인권을 침해하는 경우 문제 해결에 큰 한계를 보여준다고 지적하였다. 반면에 자유주의 시각에서 다문화주의를 접근하는 윌 킴리카나 브라이언 베리 등은 다문화주의가 자유주의적 가치에 근거하여 정립될 수 있는 것으로 본다. 이러한 시각은 그 자체 내의 논리적 귀결로서 한편으로 다문화주의를 증진시킬 수 있는 잠재력이 있으면서도 다른 한편으로는 공동체보다 개인들의 입지를 우선시하는 이론적 접근으로 소수자 문화공동체 내에서 발생하는 인권 유린에 대해서는 강한 비판의 근거를 제공한다. 이러한 논의를 바탕으로 하여 영국의 무슬림 공동체를 구체적인 사례로 다문화주의 그리고 인권문제를 살펴보았다. 무슬림 공동체는 그들이 일상생활 속에서 의존하고 있는 이슬람교의 특성상 영국 내 다수자 문화공동체의 주목과 경계를 받고 있는 것이 현실인데 특히 무슬림 소수자 공동체 내에서 보여지는 가부장적 관습들과 관련된다. 뿐만 아니라 최근 무슬림 이주자들의 2세들에게서 보여지는 과격양상은 종종 심각한 테러사태로 나타남으로써 영국 사회 내의 인권제한적인 입법으로 결과되고 있다. 물론 점점 심해져가는 자유 제한적 입법조치들에 대하여 인권단체들과 무슬림 공동체를 옹호하는 학자들은 강하게 반발하고 있지만 결국 테러에 의해 숨진 사람들을 감안할 때 잠재적 테러를 방지하기 위해서는 이러한 법들에 의하여 야기되는 불편함을 감수해야 할 것이라고 이 논문은 주장한다.
