국문 초록 (Abstract)

현대 범죄의 특징은 도시화, 사회적 연대의식의 희박, 익명성으로 인하여 흉포화, 기동화, 반인륜범죄의 증가, 무동기범죄가 증가하고 있음에도 증거수집과 탐문수사는 더욱 어려워져서 점점 사건해결이 어려워지고 있는 실정이다. 인권 및 적법절차의 강조와 함께 수사기법이나 진행과정이 언론에 방만하게 노출됨으로써 그야말로 수사환경은 더욱 열악해지고 수사밀행성의 원칙마저 침해받고 있다.죽음에 대한 실체적 진실 발견은 인간의 존엄성을 지켜주어야 할 국가의 숭고한 의무이므로, 이를 이행하기 위한 수사활동도 다른 어떤 공적 업무 이상으로 존중되어야 하고 필요한 제반 여건이 국가적, 사회적으로 뒷받침되어야 한다. 그러나 우리의 현실은 기대에 턱없이 못 미치고 있다.유영철 연쇄살인 등 흉악하고 무동기적인 범죄가 증가일로에 있는 가운데, 이러한 강력사건의 실체적 진실을 발견하기 위하여 범죄현장에의 임장에서부터 범인검거에 이르기까지 사회적으로 가능한 모든 효율적인 제도가 모색되고 협조체제가 구축되어야 함에도, 수사과정에서의 모든 것은 경찰만의 책임이며 특히 형사의 능력여하에 따라 사건이 해결된다는 생각이 당연시 되어왔다.이러한 생각은 과학수사와 전문성제고라는 면에서 우리의 수사풍토가 아직도 후진적이라는 것을 반증한다. 이러한 편협한 시각에서 벗어나 사건의 진상을 보다 명확히 할 수 있는 제도적인 뒷받침을 한시 바삐 서둘러야 한다. 과학수사의 지향, 수사 환경의 변화, 수사여건의 제도적 개선방안을 제시하여 강력사건 해결을 위한 수사 인프라 구축을 촉구하는데 본 연구의 목적이 있다.이제 선진국으로 도약하기 위해서는, 그리고 헌법상의 인간존엄과 행복추구권의 실질적 구현을 위해서라도 억울한 죽음을 당한 피해자의 권리회복과 실체적 진실 발견을 위한 제도개선에 박차를 가해야 할 것이다.이러한 목적을 달성하기 위하여첫째 살인사건 현장 등 주검이 있는 현장에는 반드시 법의학적인 지식이 있는 법의관이 현장에 임장하여 사체에 대한 감식을 할 수 있도록 현재의 검시제도는 개선되어야 한다. 그러므로 경찰이 현장에 출동하고, 의사가 출동하더라도 전문적인 법의학적 지식이 없는 일반의사가 출동한다든지, 형소법상 검사의 검시권한 등은 개선되어야 한다.둘째 아직 초보 단계지만 심리학적 수사기법인 프로파일링에 대한 심도 있는 발전이 이루어질 수 있도록 여건이 마련되어야 한다. 외국에서와 같이 체계적으로 범죄 분석이 이루어질 수 있도록 범죄분석센터를 설치 운용하여야 하고, 감으로의 수사가 아닌 실제 정식 부서로서의 책임감을 부여받아 과학적인 분석이 이루어질 수 있도록 하여야 한다.셋째 광역단위 수사체제가(광역수사단) 설치 운용 되어야 한다. 무엇보다 현재의 범죄는 광역화되어 있고 범인이 좁은 범위의 연고선에 한정되어 있지 않기 때문에 기존의 지역 경찰서 중심의 수사체제는 제고 되어야 하고, 그동안 해온 범죄정보관리, 관행적인 행정편의라는 시각에서 탈피하여 다소 시행착오가 있더라도 가야할 방향이기 때문에 빠른 시일 내에 정착이 되도록 힘을 모아야 할 것이다. 또한 광역수사체제의 핵심은 수사 지휘 상의 전문화를 지향하고 있고 있기 때문에 수사구조개혁 후를 준비하기 위해서도 시급한 과제이다.넷째 유전자정보은행의 설립이 최대한 빨리 진행되어야 한다. 증거가 없어 범인을 검거하지 못하고 수많은 살인, 강간범들이 도로를 활보하고 있는 현실은 응당 시정되어야 한다. 개인정보 보호차원의 인권침해 논란에 대해서는 제도적인 통제장치를 마련하여 남용의 소지를 불식시켜야 한다.다섯째 증거물보관소의 설치 운용이다. 범인이 바로 검거되면 좋지만 오랜 시간이 지난 후 검거될 수도 있고 이때 대부분 증거의 일실로 증거가 대부분 소실되고 있는 현실을 볼 때 증거물 보관소의 운영이 시급하다.여섯째 수사전문인력의 양성과 관리이다. 현재 경찰은 수사경과제와 죄종별 수사전담제를 실시하여 인력과 업무의 전문화를 꾀하고 있다. 그러나 방향은 맞지만 실무적으로 많은 문제점이 있다. 수사경과부여는 하더라도 전문가는 언제든지 수사에 유입할 수 있는 장치는 열어두고, 문제가 있거나 능력이 떨어지는 직원은 다시 걸러지는 장치가 마련되어야하고, 별도의 전문교육과정의 내실화와 함께 능력에 맞는 대우방안은 적극 발굴되어야 한다. 업무 면에서 수사업무의 전문화외에 수사경과 내에서도 죄종별 전문성을 제고해야 하고, 또한 각 과별로 산재된 수사업무는 수사경과내로 편입되고, 조직체계도 수사영역으로 통일 시켜야 한다.일곱째 국민의 알권리와 수사기밀간의 가이드라인이 제시되어야 한다. 사건현장취재는 일정시기까지는 보류되어 현장이 훼손되거나 선정적인 보도가 되지 않도록 법정비가 되어야 하고, 사건보도는 취재원의 정보나 기자의 추측에 의한 보도가 되지 않도록 공보관을 통해서 만이 공표되어야 한다. 수사기밀은 철저히 보도가 되지 않도록 그 가이드라인 제시가 법령의 근거에 의해 뒷받침되어야 할 것이다.여덟째 국립과학수사연구소의 위상에 관한 문제이다. 국과수는 우리나라 최고의 감정기관임에도 행자부에 소속되어 그 동안 예산과 인력 감정능력제고면에서 현실과 동떨어지거나 관심이 희박한 채로 운영이 되어왔다. 말이 많은 것이 사실이나 이제 최대한 빠른 시간 내에 정밀한 감정이 이루어질 수 있도록 인력과 장비 감정능력이 획기적으로 개선되어야 한다.이러한 소기의 목적이 달성될 수 있도록 그 직제와 운영은 발생사건과 바로 접점부서인 경찰청에 소속되도록 하는 것이 효율적이라 생각된다.아홉째 사회의 분화, 정보화, 익명화는 필연적으로 범행의 노출을 어렵게 하고 있다. 이에 따라 경찰의 역할도 커지고 수사제반 인프라의 확충도 필요하지만 또한 시민의 제보와 협조가 필수적이라 아니할 수 없다. 주민의 신고의식을 제고하기 위한 대책 등 주민협력체제 구축을 위한 방안들이 그간의 관주도의 형식적인 구성이 아니라 실질적으로 활성화 될 수 있도록 힘써야 할 것이다.

다국어 초록 (Multilingual Abstract)

Everyone has dignity of life, they want happy life and have rights to live happy. To guarantee these constitutional rights substantially, public security might be needed at any country.The service area of police public security is the most sensitive, prompt, flexible one than any other administration area. Because, nowadays violent crimes augment in an alarming way, and they are becoming highly undistinguishing, amotivational, demoniac and mechanized.On this score, we must improve investigation environment to control violent crimes which violate another''s property and destroy a happy family. And there is no room for reconsideration that a importance of investigation environment''s reformation must be recognized as another duty of Country.To control violent crimes a prevention is important thing, but from Police standpoint, how we arrest criminals quickly is the most serious point.Despite of these importance, a investigation infrastructure for arrest is in poor surroundings.When police could not arrest a violent criminal, people criticized police severely, however there was not a improvement of investigation environment but a disposable promise.To be a advanced country, to realize substantially the dignity of human lifes and the right to pursue their happiness, we should accelerate to improve the investigation environment which can investigate a mysterious death and find a substantive truth.So this master''s thesis make some conclusion below.Firstly, we must reform the existing autopsy regulations. So there was no concern and treatment equivalent to its ability.From now, to judge in record time and with perfect accuracy, we must expand its workforce and improve judgment equipment, and to achieve those purpose, the National Scientific, Criminal & Investigation Laboratory should be under the control of the National Police Agency which deal with violent crimes(any other a criminal case included).The ninth, the present society become idifferentiated, information-oriented and anonymous. Such a change makes hard to find crimes and there is no one who can deal with violent crimes but the National Police Agency.To do Police''s role, some informations and assistances from the citizens are necessary as well as the investigative infrastructure.So the population''s cooperative system will be prepared not by a government agency''s red tape but by a substantial revitalization in cooperation with the population.
