기억의 규제와 규제를 통한 기억하기?: 홀로코스트 부정(Holocaust denial) 규제 법제와 사회적 기억의 구성 = Regulating Memory and Remembering through Regulation? : Law against Holocaust Denial and the Construction of Social Memory

The objective of this article is to do a discourse analysis on legal mechanisms for regulating the representation of history with particular reference to the rules governing denial and distortion of key traumatic events In pos World War 2 Europe, and to study the ways in which U1ey militate or penetrate into the memory space of postcolonial/post dictatorial East Asia. My hypothesis is that social memory or shared remembrance IS shaped and reproduced by regulatory discourse, and that the application of regulatory instrwuents to negationism simultaneously constructs and is constructed by transnational memory space. Tha is to say, sanctions against denial of the past actively manipulate memory discourse rather than passively suppressing misrepresentations of history. They can even act in a counter-productive way by provoking images and narratives such as fascination with the totalitarian order or Orientalist visions of colonial occupation. This research begins by s udying the reproduction of discourse surrounding the regulation of Holocaust denial in Europe in order to understand how it informs and in eracts with the controversy over legal norms on the denial and distortion of the past in East Asia. Then it continues to explore the ways in which moral controversies over distortions of history serve to generate and reproduce nostalgia for an imagined community. It will give particular a tention 0 aspects that expose double layers of collusion between apparently oppositional interests￢a combination of conservative legal norms(of expanding criminal justice) and progressive political practice, and a symbiosis between two otherwise mutually exclusive forms of nationalism or racism. My article aims to explore these effects in the context of European sanctions on Holocaust denial and consider how far the similar process is at work in cw-rent debates over he representation of key trawnatic events in history.
