소청심사의 공정성 강화를 위한 법제적 개선방안 = Legal Improvement Measures for Reinforcing Fairness of the Appeal System

Regarding the appeal system, the following fairness issues have been continuously raised. First, the acceptance rate of the petition is excessively high. Second, the decision of appeals review committees is affected by the position of the appellant and the relationship between the appellant and the appeals review agency. Third, there is a large variation in the acceptance rate for each appeal review agency and there are different decisions of appeals review committees for similar cases.
The internal cause of this issue of fairness is the lack of independence and expertise of the appeals review committees. First, the independence problem of the appeals review committees arises from the fact that the composition of the appeals review committees is entirely determined by the will of the specific institution to which the appeals review committees belongs(problem of human resource independence). In addition, the lack of expertise of the appeals review committees mainly arises from the ambiguous and mixed division of roles between experts who have a high understanding of the task(facts of appeals) and legal experts.
On the other hand, the external cause of the issue of fairness is the lack of control over the decisions of appeals review committees. Except for the current limited request for review by the Board of Audit and Inspection, in principle, the appellee cannot file an administrative lawsuit against the decisions of appeals review committees, so there is virtually no external control of legality. The decisions of appeals review committee cannot be subject to judicial review unless the Appellant disagrees, despite the lack of substantive and procedural justification due to incomplete summary disputes compared to litigation.
Therefore, in order to correct the issue of fairness related to the appeals review system, the following improvement measures are needed to resolve these internal and external causes.
① In order to enhance the human resource independence of the appeals review agencies, the establishment of an integrated local appeals review committee, multilayerization of the authority to form the appeals review committee shall be promoted.
② In order to enhance the professionalism of the appeals review committees, it is required to distinguish and coordinate the roles of legal experts and experts about facts of appeals, and to diversify the composition of internal public officials who can become experts about facts of appeals.
③ As a legality and validity control device for a decision of appeals review committees, the authority to file an administrative lawsuit by the appellee must be newly established. In this case, institutional means must also be prepared to control the appellee not to abuse the authority to file an administrative lawsuit for unfair purposes, depending on the relationship with the appellant.
