드론 산업의 법률적 규제 합리화 방안 : 무인비행장치 법규 중심으로

국문 초록 (Abstract)

최근 우리 사회의 드론산업이 양적으로 증가하고 있고, 질적으로도 고급화·첨단 화 되어 가고 있다. 또 다른 여러 가지 기술적·기능적 사고가 끊임없이 생기고 있어 사회적 불안감이 높아지고 있는 상황에서 우리 국민들은 보다 질 높은 드론산업을 추구하고 있으며, 보안이나 안전에 대한 욕구도 급격하게 증가하고 있다. 하지만, 제한된 규제와 법규만으로는 늘어만 가는 민간 드론 수요와 국민들의 다양한 욕구 충족에 적절히 대응하기 어려운 상황에서 드론 산업의 법률적 영역이 그 해결방안 으로 제시되고 있다. 드론은 조종사 없이 무선전파의 유도에 의해서 비행 및 조종이 가능한 비행기나 헬리콥터 모양의 군사용 무인항공기(UAV : unmanned aerial vehicle / uninhabited aerial vehicle)의 총칭으로 드론 산업의 시작은 1900년대 초기 군사 목적으로 시작 으로 급속한 성장을 해왔으며, 2018년 현재 미래를 이끌어갈 주축 산업으로 사회 전반에 드론 산업이 급속한 성장세를 보여주고 있다. 양적·질적인 면에서도 군사용 위주의 단순한 방위 목적에서 최첨단장비 및 기술을 활용한 융·복합적인 형태로 발 전하고 있다. 하지만, 이와 같은 급격한 양적 성장의 이면에서는 양적인 성장과 질 적인 성장에 있어서 여러 가지 문제들이 나타나고 있다. 특히, 드론 산업에 대한 제 도적 정책과 법제화 그리고 필요한 인력 양성에 대한 체계적이고 순환적인 교육의 미흡 및 전문 직종으로 정착이 되지 않는 등 여러 가지 난제를 안고 있는 것으로 보여진다. 따라서 이 연구에서는 드론 산업의 전문성 및 질적 향상을 위하여 초경량비행장 치 자격취득 관련 법규 중심으로 교육훈련 제도적 문제점 및 개선점을 찾고 현재 시행되고 있는 드론 관련 법규의 규제 모순점을 분석해 합리적 개선방안을 제시하고자 한다.

다국어 초록 (Multilingual Abstract)

Recently, the drones industry in our society has been increasing in quantity and quality has been getting higher. In addition, as technological problems are constantly arising and social uneasiness is rising, Korean people are pursuing a higher quality drones industry, and the demand for security and safety is rapidly increasing. However, with limited regulations and laws, it is difficult to respond to the increasing demands of private drones and the diverse needs of the people. Dron is a collective term for UAVs that can be controlled by induction of radio waves without pilots. The drones industry started from military purposes in the early 1900s and has grown rapidly since then. This shows rapid growth. In both quantitative and qualitative terms, the drones are evolving into a complex form utilizing advanced technology as well as military defense purposes. However, there are a number of problems in the face of this rapid growth. In particular, the lack of systematic education on the institutional policy and legalization of the drones industry and the training of necessary manpower seems to be causing problems such as the drone not being settled as a professional occupation. Therefore, in order to improve the professionalism and quality of the drone industry, this study aims to find institutional problems and improvements of education and training centered on laws and regulations related to the acquisition of ultra - light aircraft devices. We also analyze the contradictions in the regulation of the drones and propose a reasonable improvement plan.
