성희롱 과잉,과소 규제에 관한 페미니즘 및 윤리학적 연구 = The Study of Feminism and Ethics about Over Regulation and Under Regulation of Sexual Harassment

다국어 초록 (Multilingual Abstract)

The purpose of this study is to prevent and review counter-action for the sexual harassment in the legal regulation by revealing current feminism and ethics with regard to sexual harassment In Korea, sexual harassment has attracted public attentions at Ms. Woo case in 1993. But the meaning of regulation`s scope and female`s identity about sexual harassment is somewhat obscure. So, this paper deals with the issues when feminists take law as a strategic way. Firstly of all, by relying on MacKinnon`s feminist jurisprudence which lays a foundation to provide sexual harassment policies, it is addressed what sexual harassment law aims at so that it provides a basis for a further criticism of sexual harassment law. From the view of liberal feminism, sexual harassment law may distort the autonomy although it originally aims at gender equality. According to postmodern feminism, sexual harassment law tends to provide women with a fixed idea of a sexually pure and vulnerable victim. Ironically, this is the stereotypes of gender identity of men and women that sexual harassment law originally tries to correct. This study reveal the reality of sexual harassment of women human rights and seek the alternative direction. The result of this research with regard to sexual harassment is under following: For the ethical and regulatory discussion and solution, I suggested the dilemma of over-regulation and under-regulation. And I suggested the need for strong regulation. After all, I suggested the direction of a stronger regulatory alternative with communicative approaches to sexual harassment.
