국문 초록 (Abstract)

이제까지 정의의 영역에서 배제되었던 동물을 정의의 영역에 포함시킨 너스바움의 입장을 살펴본다. 먼저, 동물도 우리처럼 정의의 영토의 구성원으로 보는 관점의 변화를 위해 우리의 공감력을 반성적으로 성찰해 본다. 우리의 공감이 어떠한 타락의 기제를 갖고 있는지 살펴봄으로써, 잘 계발된 우리의 공감은 동물로 한계 없이 확장될 수 있음을 본다. 동물의 자연적 권리를 실질적으로 보장하기 위하여, 롤스의 정의론을 수정하는 누스바움의 시도를 검토해 본다. 롤스의 정의론이 기반하고 있는 사회계약설은 계약주체자와 계약배제자의 원초적 불균형의 문제를 안고 있다. 계약배제자로서의 동물은 정의의 대상이 아닌 인도주의적 연민과 자애의 대상일 뿐이다. 계약배제자로서의 동물의 자연적 권리를 실질적으로 회복시켜 지구적 정의의 실현을 가능케 하는 너스바움의 동물능력지원접근법을 소개한다.

다국어 초록 (Multilingual Abstract)

This paper is to understand the theory of animal rights offered by Nussbaum. Her theory distinguishes itself that animal species is included in the frontiers of justice. First, in order to acknowledge that animals belong to the realm of justice like us, I examine a possibility that our compassion could reach to animal species without limit. By critical examination of self-contaminating mechanism of our compassion, we could find out how to cultivate it. Next, in order to secure natural rights of animals in the realm of justice, I review Nussbaum``s attempt to revise Rawl``s theory of justice. In the theory of social contract on which Rawl``stheory is based, there is an original discrepancy between the parties participating the contract and the parties being excluded. The problemis that animals should depend on our pity and humanity. The animal capabilities approach is introduced to ensure basic entitlement of animal rights which is excluded in the original contract
