구조기능주의와 역사사회학에서 국가론 논쟁의 고찰 = A Study on the Theory of State Controversy upon the Structural Functionalism and Historical Sociology

국문 초록 (Abstract)

민주주의와 국가의 관계는 중요하다. 국민국가 개념에서의 민주주의 혹은 시민권은 국민을 시민으로 즉, 개인으로서 한 사람 한 사람에게 동일한 권리를 인정한다는 원칙을 따른다. 그런데 국가 없는 삶이 상상이 안 되는 지금 국제정치 상황에서 영국학파라고도 불리는 국제사회론자들은 국가 간에는 일반적인 관습과 규범을 공유하는 결과 자기조정의 틀이 발달한 사회라고 부르는 관계가 성립되어 있다는 논리를 전개한다. 이 개념은 주권국가를 유일한 행위자와 그 주권국가의 관계로 국제사회를 이해한다. 이러한 국가의 이해는 국가의 시스템에 존재론적 우위성을 부여하고 그것이 결과적으로도 규범적으로도 국가의 체제 안정을 우선하는 경향이 있다는 점에서 현실주의 국제관계의 계보를 이루고 있다. 근원적이고 다원적인 민주주의를 슈미트(Carl Schmitt)의 주장처럼 정치적인 것에 의거하여 갈등과 적대관계가 존재하는 것이 정치의 본질이라는 인식을 가지고, 민주주의 국가의 방향을 검토한다. 시민권과 민족주의의 주권 이념에 기반을 둔 국민국가는 시민권은 민족주의와 어떠한 내재적인 친화성이 있는 것일까? 본고의 목적은 국민국가를 재생산하는 메커니즘의 정치적 분석을 시도할 것이다. 특히 여러 국가체제(States-System)와 국민국가(Nation State)의 의제성에 초점을 맞추고 그 양자의 상호보강 관계를 밝히고자 한다. 그러나 국민국가와 국가시스템의 상호보강 관계를 나타내는 것은 그 구조가 영원히 계속된다는 것을 주장하는 것은 아니다. 냉전구조에서 규정된 국가의 구축이 냉전구조의 붕괴에 의해 그 존립 기반을 잃는 것은 당연하다고 할 수 있다. 그러나 그 결과는 국민국가 자체의 부정이 아니라 반대로 국제적 조건의 변화에 대응한 국민국가의 재구성이라고 할 수 있다. 본 연구에서의 한쪽 구석에 모인 관심의 배경에 있는 문제는 전통 법학의 관심과는 다르다. 특히 필자가 법학연구의 과정에서 품게 된 의문은 국내적 요인 보다는 국제적 요인에 권력의 기반과 정당성을 의존하는 국가의 한 측면을 고찰하기 위해서는 어떤 분석틀을 사용해야 하는가라는 과제였다. 이 과제에 대해 본고에서는 베버적 국가론을 바탕으로 국제관계와 관련하여 국가를 고찰한 역사사회학의 국가론의 검토를 통해 고찰한다. 본고는 지금까지의 토론을 보충하는 형태로 역사사회학에 의한 국가론의 재론과 여기에서 국제적 관점의 중요성을 충분히 평가하면서 아울러 그것의 한계를 제시함으로써 지금의 법학계에서는 빈약한 국가론 논의의 발전에 기여하고자 한다.

다국어 초록 (Multilingual Abstract)

The relationship between democracy and the state is important. Democracy or citizenship in the concept of a nation-state follows the principle that peoples as citizens, that is, as individuals, recognize the same rights to each and every person. However, in the context of international politics, where life without a state is unimaginable, international social theory, also called the British School, develops the logic that a relationship called a society with a developed framework of self-regulation is established as a result of sharing common customs and norms among countries. This concept understands the international community as the sovereign state as the relationship between the sole agent and the sovereign state. This understanding of the state constitutes the genealogy of realist international relations in that it gives an ontological superiority to the systems of the states, and as a result, normatively, it tends to prioritize the stability of the systems of the states. Based on the politics of Carl Shumitt’s fundamental and pluralistic democracy, it examines the direction of a democratic state with the perception that the existence of conflict and hostility is the essence of politics. In a nation-state based on the sovereign ideology of citizenship and nationalism, what kind of intrinsic affinity does citizenship have with nationalism? The purpose of this paper is to attempt a political analysis of the mechanisms that reproduce the nation-state. In particular, it focuses on the agendas of various states-systems and nation states, and attempts to clarify the mutual reinforcing relationship between the two. However, expressing the mutually reinforcing relationship between the nation-state and the national system does not claim that the structure will last forever. It can be said that it is natural that the establishment of a state largely defined by the Cold War structure loses its foundation for existence by the collapse of the Cold War structure. However, the result is not the denial of the nation-state itself, but on the contrary, the reconstruction of the nation-state in response to changes in international conditions. The problem in the background of the attention gathered in one corner in this study is different from that of traditional law. In particular, it was the task of which analysis framework should be used to examine an aspect of the state that relies on the foundation and legitimacy of power on international factors rather than on domestic factors that I had in the course of legal studies. This paper examines this subject through a review of the state theory of historical sociology, which examines the state in relation to international relations based on Weber’s theory of state. This paper aims to contribute to the development of the discussion of state theory, which is weak in the current legal world, by fully evaluating the importance of the international perspective and re-introduction of the national theory by historical sociology as a supplement to the discussion so far.
