사행산업통합감독위원회법에서 경마가 제외되어야 하는 이유에 대한 연구 = A Study on the Reason for Horse Racing to Be Excluded from the Speculative Industry Integrated Supervisory Commission Act - Focused on the opinion to abolish off‐track betting places

국문 초록 (Abstract)

국어사전에는 사행(射倖)에 대해 ‘요행을 노림’으로 풀이하고 있다. 이 정의에 의한다면 경마는 사행산업이 될 수가 없다. 그런데도 무리하게 사행산업통합감독위원회법에 포함시켜 진짜 사행산업들과 통합적으로 규제하는 것은 옳지 않다.
경마산업은 사행성 게임물, 로또복권, 카지노 등 진짜 도박과는 확연히 다른 특징이 있다. 도박은 순전히 요행이나 운에 의존하여 횡재를 하는 것을 의미한다. 그러나 경마는 요행이나 운에 의존하기 힘들다. 경주마가 태어나서 육성되고 훈련을 거쳐 실전에 투입되는 전 과정의 정보를 분석하고 추리하는 능력이 있어야 한다. 그렇기 때문에 스스로 연구하는 노력을 전제로 한다. 순전히 요행이나 운에 의존하는 게임물 복권 카지노와는 확연히 구분이 되는 것이다. 경주마의 능력을 70% 기수의 기승술을 30%로 전제하여 각종 과학적이고 합리적인 자료를 토대로 분석과 추리를 해야 하는 게임이다. 경주마를 분석할 때는 어떤 아비마와 어미마 사이에서 태어났는지를 따져보아야 하며 어떤 목장에서 어떻게 생산되고 육성되었는지 어떤 조교사가 어떻게 순치를 시키고 훈련을 시켰는지 어느 기수와 호흡이 잘 맞는지.....등 무려 100여 종류가 넘는 우승요인을 토대로 분석과 추리를 해야 하는 특징이 있다. 따라서 경마는 사행산업통합감독위원회법에서 제외되어야 한다.

다국어 초록 (Multilingual Abstract)

As the Speculative Industry Integrated Supervisory Commission set to work in earnest, things that people had concerned over are being actualized. What is more, the Speculative Industry Integrated Supervisory Commission consists of people related to the Ministry of Culture and Tourism, excluding those from racehorse breeding and stock raising companies, and this structure is diminishing the position of horse racing and increasing concern. Even because those recommended by the Ministry of Agriculture and Forestry do not have a correct understanding of the horse?racing industry, it looks almost impossible for the Speculative Industry Integrated Supervisory Commission to represent the horse?racing industry.
After all, Korean horse racing has fallen into the situation of a patient with a serious disease in need of urgent treatment. The patient is drawing his last breath. Without urgent treatment, the patient cannot revive. If he stops breathing, all medicines are useless. The horse industry is being attacked from all directions. Although the world has become like a village living together, Korea keep thinking and doing in a strange way. Although horses had been the main actors of the history of the Korean Peninsula, now the country is not only neglecting but also wiping out them. How could Koguryo be founded, and how could the three Hans be unified without horses?
Frankly speaking, isn’t it the sublime spirit of the nomadic tribe that Korea has grown into the world’s 11th economic power? When our ancestors crossed the Manchurian plain and the Liaodong Peninsula and expanded its territory deep into the Chinese Continent, their ambition and wisdom were riding horses. But now we are clamoring against the horses. Isn’t this what our ancestors in Koguryo, Baekje and Shilla would grieve bitterly? The Assemblymen who put horse racing under the Speculative Industry Integrated Supervisory Commission Act and proposed various regulative bills for changing the Korea Racing Authority Act for the worse are all traitors to the nation and criminals against history.
The author has been emphasizing repeatedly that horse racing cannot be gambling because it is a sport predicting winning horses based on the horses’ power 70% and the jockeys’ skill 30%. Compared to lotteries, casinos, bicycle racing, motorboat racing and sports toto that the National Assembly and the government try to regulate, horse racing is different by nature but they do not accept the difference. Lotteries and casinos are obviously gambling relying purely on chance and luck. Bicycle racing, motorboat racing and sports toto are also far different from horse racing in that they select the winner or the winning team based on the players’ abilities. Nevertheless, horse racing is treated in the same way as other gambling games, and even as the leader of gambling. This is really regretful.
Due to various regulations imposed by politicians, the Korean horse industry has fallen sick seriously, and is facing its death. Even some people suggest letting the industry die out and building up again from scratch. Another voice is that the Speculative Industry Integrated Supervisory Commission Act has already been beyond the control and efforts should be concentrated on lowering leisure taxes. However, the current crisis originated from the Speculative Industry Integrated Supervisory Commission Act. If horse racing cannot cast off the regulation by the Speculative Industry Integrated Supervisory Commission Act, it cannot take even a step forward. Therefore, the whole strength should be poured into pulling horse racing out of the Speculative Industry Integrated Supervisory Commission Act. If the horse industry dies, all is over.
In this sense, treatment should be made while it is still breathing. The Ministry of Agriculture and Forestry in charge of the Korean horse industry, the Korea Racing Authority operating horse racing, and all personnel involved in the horse industr
