The introduction of the concept of living time came from the need to find a solution to long working hours of workers in Japan as a national issue, not just a problem for workers. In particular, with the request for revision of the Japanese Labor Standards Act in relation to working hours, the introduction of living hours was discussed in depth with the goal of achieving a work-life balance for workers.
I would like to propose a way to legislate the Labor Standards Act to secure living-hours in addition to working hours and rest. In other words, along with the introduction of the concept of living-hours, working hours for work-life balance are legally guaranteed, and employers are obligated to actively consider securing such living-hours. This is because it is possible for the employer to assume, in addition to the main duty to pay wages, the duty to care for the health of workers, that is, the duty to consider living-hours, as an incidental duty. Of course, the legal basis for the duty to consider life time as an incidental duty in the labor contract in the Labor Standards Act remains to be clarified by enacting a separate labor contract law, as in Japan.
