Online Rating System vs. Free Expression : Towards a Right Option for Regulating Internet Pornography

국문 초록 (Abstract)

대중매체가 음란물을 매개할 수 있는가는 해묵은 주제이다. 동시에 말끔히 해결되지 않았고 해결 가능성 또한 불투명한 문제이다. 최근 이 주제가 인터넷이란 새로운 매체를 둘러싸고 다시금 논란거리로 떠올랐다. 논란의 불씨는 지난 4월 정보통신부가 인터넷상의 음란, 폭력물로부터 청소년들을 보호하기 위해 "인터넷내용등급제"를9월부터 시범 도입하고 내년7월부터 전면 실시한다고 밝히면서 살아나기 시작했다. 인터넷내용등급제는 정보제공자가 정보내용을 일정 기준에 따라 등급으로 표시하면 정보이용자가 이 내용 등급을 참고해 사이트를 선택하는 방식이다.
우리나라는 외국과 달리 매체의 특성에 따라 부여되는 표현자유의 범위에 큰 차이가 없다. 그럼에도 불구하고, 인터넷 등장 및 대중화와 더불어 표현의 자유가 새삼스럽게 불거져 나오는 이유는 기존 대중매체와 뚜렷하게 구분되는 인터넷의 기술적 특성 때문이다. 네트워크들의 네트워크로 불리는 인터넷은 다양한 방식의 커뮤니케이션을 가능하게 할 뿐만 아니라 누구나 간편하고 저렴하게 자신의 의사를 표현할 수 있게 한다. 인간의 커뮤니케이션이 극대화 될 수 있는 공간이자 매개체인 인터넷을 상대로 아무리 음란물이라 하더라도 그 내용을 규제하려는 시도이기 때문에 표현의 자유를 침해할 우려가 있다는 목소리가 높아지고 있는 것이다.
이 글은 별다른 의심의 여지없이 통용되고 있는 인터넷 내용에 대한 규제가 표현자유를 침해한다는 논리를 새로운 시각에서 고찰한다. 논의의 대부분은 우리나라보다 앞서 유사한 논란을 겪은 미국의 사례를 중심으로 전개한다. 이 글은 궁극적으로 인터넷 내용 규제와 표현자유를 둘러싼 우리의 학문적 논의를 자극하고 정책입안자들에 대한 유용한 시사점 제공을 목적으로 한다.

다국어 초록 (Multilingual Abstract)

On April 5, 2000, the Ministry of Information and Communication unveiled a package to rate Internet content in a bid to keep minors over online computer networks from indecent or patently offensive materia. The governmental scheme has created a heated debate over the constitutionality of the use of Internet content ratings and filtering mechanism to the extent that 27 civic groups lined up to issue a statement in July criticizing the proposal as "the National Security Law on the Internet. Their main concern is that the application of a universal Internet rating system and widespread filtering software infringes upon freedom of expression guaranteed by the Korean Constitution.
This article examines whether requiring filtering software and online rating system to censor pornography on the Internet conflicts with Internet users' free speech rights. It concerns much more with free expression issues than the welfare of minors in regulating pornographic materials on the Internet. In doing this, the article deals with the American case because making relevant analyses of the earlier experience can stimulate a constructive debate in the future and draw some lessons for Korean policy-makers. The United States has undergone the very similar dispute over the constitutionality of requiring a rating system to block pornographic materials on the Internet especially since the Supreme Court ruling in Reno v. American civil Liberties Union (ACLU) in June 1997. Any discussion of free expression in the United States must start with the First Amendment because the notion of free speech is embodied in the amendment to the United States Constitution.
This article presents a rationale for the regulation on pornography in terms of an instrumental perspective of the First Amendment whose purpose is to advance democratic self-government, rather than to permit individual self-actualization. In conclusion, it argues that using filtering tools linked to Internet content rating systems would be best for the future in that they, empowering Internet users, offer technical solutions at the listener end.
