강ㆍ절도의 공범집단 : 공범집단의 동질성과 범행지속성에 대한 탐색적 연구

국문 초록 (Abstract)

공범이 있는 사건과 단독범에 의한 사건, 그리고 단독범죄자와 공범의 형태로 범행을 저지르는범죄자들의 차이에 대한 인식은 오래 전부터 있었고 공범에 관한 형법적 논의도 활발한 것과는달리, 공범관련 실증연구는 매우 부족한 실정이다. 특히, 공범관련 실증적 선행연구들은 청소년비행에서 공범에 주목하거나 마약범죄와 같이 특정범죄에 주목하여 공범을 이해하고자 하는 등의제한적인 연구주제에 머물러 있는 경우가 많았고, 공범집단에 주목한 연구는 거의 이루어지지 않았다. 본 연구에서는 이러한 선행연구의 한계를 인식하고 공범집단의 특성규명을 위해 강도와 절도의 공범집단 구성원의 특성과 동질성, 범행지속성을 살펴보고자 하였다. 이를 통해, 영미의 선행연구에서 비교적 일관되게 주장해 온 ‘공범집단은 매우 유사한 동질성이 높은 구성원으로 이루어지며, 이들의 범행은 지속성이 낮아 1-2회에 그치는 경우가 많다’는 특성이 우리의 강도 및 절도 집단에 어떻게 적용되는지를 알아보고, 선행연구에서 주목하지 않았던 공범집단의 범행지속성에 영향을 미치는 요인이 무엇인지를 살펴보고자 하였다. 수사재판기록조사를 통해 수집한 자료를 분석하였고 공범의 형태로 범행을 저지른 405명의 강ㆍ절도 범죄자가 구성하고 있는 146개 공범집단을 분석단위로 활용하였다. 조사결과, 공범집단은 평균 2.99명으로 구성되어 3.2건의 범행을한 것으로 나타나, 영미의 연구결과와는 다른 특성을 보였으며, 공범집단 구성원의 평균연령은26.3세, 전과자 비율은 37%, 무직자 비율은 54%에 이르는 것으로 나타났다. 연령대별로 공범동질성에 차이가 있는 것으로 나타났는데 10대 공범집단은 20대 및 30대 이상의 집단과 비교하여 연령 동질성은 강하고 성별 동질성은 상대적으로 약하다는 차이가 있었다. 공범집단의 범행지속성에 영향을 미치는 요인을 살펴본 결과, 범행건수로 측정된 범행지속성은 집단구성원의 동질성보다는 범죄집단의 규모 및 무직자 비율에 영향을 받는 것으로 나타났다.

다국어 초록 (Multilingual Abstract)

The current study examines characteristics of co-offending groups in Korea focusingon burglary and robbery. Despite the academic awareness of the criminal co-offendingand co-offenders, previous studies in criminal justice did not pay much attention on theissue of co-offending and co-offenders empirically. In Korea, discussions on co-offendingand co-offenders are heavily focus on the legal issues. Acknowledging the gap ofprevious studies, this research is planned to examine characteristics of co-offendinggroups who commit burglaries and robberies together. In particular, this study has threepurposes; to replicate previous findings of co-offending group characteristics on theco-offenders in Korea, to evaluate the homogeneity of co-offenders, and to examinecontinuity of offending among co-offenders. Data gathered from the reports of criminalinvestigation, and the unit of analysis is criminal offending groups. Information on the146 offending group from 405 co-offenders of burglaries and robberies are analyzed, andthe results are discussed with the implications of findings.
