인권에 대한 자연주의적 탐구 - 로티와 설을 넘어서 - = A Naturalistic Inquiry of Human Rights - Rorty, Searle, and Beyond -

국문 초록 (Abstract)

이 논문의 주된 목적은 인권에 대한 지적ㆍ실천적 문제 해결을 위해서, 인간의 경험의 본성과 구조에 대한 자연주의적 탐구가 필요함을 주장하는 것이다. 그리고 여기에서 말하는 인간 경험의 본성에 대한 탐구는 그것의 원천으로서의 인간의 몸과 마음, 그리고 그것의 배경이 되는 자연과 사회에 대한 탐구를 포괄한다. 이러한 주장을 위해서 필자는 인권에 대한 자연주의적 접근을 대표하는 로티와 설의 논의를 비판적으로 조명할 것이다. 또한 체험주의의 인간 경험에 대한 해명이 인권과 관련된 탐구에 대해서 가지는 의미를 적극적으로 드러낼 것이다. 로티는 인권 문화 확산을 위해 우리가 해야 할 가장 중요한 일은 타인의 고통과 굴욕에 대한 감수성을 가질 수 있도록 노력하는 것이라고 주장한다. 나아가 그는 인권의 존재론적 본성과 인간이 공유하는 특성에 대한 탐구는 인권 문제 해결에 쓸모가 없다고 말한다. 반면에 설은 인권의 존재론적 본성과 구조에 대한 탐구가 인권의 존재 여부를 둘러싼 갈등 해소에 기여할 수 있다고 주장한다. 그리고 그는 인권 목록에 대한 합의를 위해 인간의 생물학적 특성과 가치평가와 관련된 인간 본성에 대한 탐구가 필요함을 역설한다. 인권과 관련한 논쟁의 핵심적 문제는 인권 목록의 합의와 관련한 것이라는 측면에서, 인권의 본성과 구조에 대한 설의 해명은 인권에 대한 로티의 해체론적 입장을 넘어선 것으로 보인다. 하지만 설의 논의는 인간의 가치평가의 본성에 대한 체계적인 해명에는 이르지 못한 것으로 보인다. 이러한 측면에서 인간 경험의 본성과 구조에 대한 체험주의적 해명은 설의 제안이 자연주의적 용어를 통하여 보다 완전하게 설명될 수 있는 방식을 보여준다. 체험주의에 따르면 가치평가를 포함한 인간의 모든 경험은 신체적/물리적 층위의 경험에 근거하며 동시에 그것에 의해 제약된다. 또한 신체적/물리적 층위의 경험은 현저한 공공성을 드러낸다. 따라서 인권 목록에 대한 합의는 종(種)으로서의 인간이 공유하는 ‘경험의 공공성’에 근거하여 이루어져야 한다. 경험의 공공성에 대한 탐구는 몸과 마음 그리고 자연과 사회에 대한 탐구와 결부되어야 한다는 측면에서, 인권에 대한 탐구는 이것들에 대한 자연주의적 탐구에 근거해야 한다.

다국어 초록 (Multilingual Abstract)

The main purpose of this paper is to argue that a naturalistic inquiry into the nature and structure of human experience is necessary to solve intellectual and practical problems concerning human rights. And the inquiry of the nature of human experience referred to here encompasses the inquiry of the human body and mind as its source and nature and society behind it. To do this, I will critically highlight the discussions of Rorty and Searle, who both stand for a naturalistic approach to the issue of human rights. I will go further to explicate the experientialist account of human experience which comprises the very notion of human rights as its part. Rorty argues that the most important thing we need to do in order to spread the culture of human rights is to try to be more sensitive to other people’s pain and humiliation. Furthermore, he argues that exploring the ontological nature of human rights and the essential elements shared by humans is useless to solve human rights problems. On the other hand, Searle argued that the inquiry into the ontological nature and structure of human rights may help to resolve the debates over the existence of human rights. And he exhorts to explore human nature in relation to biological elements and human valuation to reach a consensus on the list of human rights. Since the key issue in the discussions of human rights is the problem of reaching a consensus on the list of human rights, Searle’s suggestion for the clarification of the nature and structure of human rights seems to afford a way to go beyond Rorty’s deconstructive stance. However, Searle’s position yet seems to fall short of explicating the nature of human valuation. In this respect, the experientialist account of the nature and structure of human experience shows how Searle’s suggestion can be more fully recounted in naturalistic terms. According to experientialism, all human experience, including valuation, is grounded in, and at the same time constrained by the bodily/physical level of experience, which reveals salient degree of commonality. Therefore, the consensus on the list of human rights should also be based on ‘the commonality of experience revealed by humans as species. The experientialist account of the commonality of experience, while encompassing mind and body, and at the same time, nature and society, shows the necessity and the possibility of further naturalistic inquiry into the issues of human rights.
