붓다의 화합정신 강조와 그 현대적 의의 - 율 제정의 의미와 정신을 중심으로 -

국문 초록 (Abstract)

율은 깨달음이라는 목적에 따른 수단이며, 수단은 목적을 위해서 복무해야할 필요가 있다. 그럼에도 제도적인 특성상 처음에는 소속원을 위해서 구조화되지만, 결국 공포되면 이는 동시에 소속원을 규제하게 된다. 이렇게 놓고 본다면, 제도는 수단의 가치임에도 불구하고 목적화 되는 오류의 개연성을 내포한다. 본고는 불교승단의 제도인 율장의 의의를, 붓다의 근본정신과 관점의 문제를 통해서 보다 합리적인 입각점을 도출해 본 것이다. 이러한 측면에서 제Ⅱ장에서는 ｢율 제정의 이유와 목적｣을 통해, 인도문화적인 배경과 붓다의 制律정신에 대해서 정리해 보고자 하였다. 다음으로 제Ⅲ장에서는 ｢和合僧과 行籌人의 역할｣을 통해서, 붓다 율 정신의 구체성에 대해서 파악해 보게 된다. 승가의 제1가치는 和合僧이다. 이와 관련해서 붓다의 의결제도 중 多人語에서 살펴지는 議長격인 행주인의 작위성에 대한 검토를 개진해 보고자 한다. 이를 통해서 우리는 붓다의 제율정신의 핵심이 和合僧과 如法性이라는 관점을 확보해 보게 된다. 끝으로 제Ⅳ장에서는 ｢불교의 군주론과 붓다의 승단운영 遺志｣에 대해서 검토해 본다. 불교의 군주론은 승단인식에서 제출된 구조라는 점에서, 붓다와 승단이 가지고 있었던 권력에 대한 관점을 확보해 볼 수 있는 부분이다. 그러므로 이를 통해서 우리는 율장에서 살펴지는 座長에 대한 인식을 보충 받아 볼 수 있는 동시에, 승단지도자의 역할에 대해서도 관점을 환기 받아 볼 수 있게 된다. 제도는 변화를 통해서 생명력을 가진다. 즉, 제도는 특정 사회성 속에서의 한계적인 진리일 뿐이라는 말이다. 이런 점에서 붓다의 근본정신을 정리하여 율의 탄력성을 되살리는 작업은 매우 의미 있는 노력이라고 하 겠다.

다국어 초록 (Multilingual Abstract)

Vinaya is a means for the purpose of awakening, and the means should serve for the purpose. Despite it, in its characteristics the vinaya is structured for the members at first but, once it is promulgated, it constraints the members after all. In this respect, though the system has just the value as a means, it includes the probability of error that the means becomes the purpose. This paper tries to derive a more rational ground for the meaning of vinaya a system of Buddhist Samgha through the Buddha's fundamental spirit and viewpoint. In that aspect, chapter II ‘The Reason and Purpose of Vinaya Establishment’ summarizes the background of Indian culture and Buddha's spirit in his vinaya establishment. In chapter III ‘Roles of Samagga-samgha(和合僧) and Sala-kaga-ha -paka(行籌人)’, the Buddha's vinaya spirit is examined more concretely. The first value of Samgha is the samagga-samgha. In relation with it, this chapter reviews the role of Sala-kaga-ha-paka who takes the president at the yebhuyyasika(多人語) in Buddha's decision-making system. Through this, we can recognize that the essence of Buddha's vinaya establishment is the samagga-samgha and the conformity. Finally, chapter IV deals with ‘Buddhist Monarchy Theory and Buddha's Legacy in Samgha Management’. In that the Buddhist monarchy theory is a structure derived from the samgha conception, it can reveal the viewpoints of Buddha and samgha about the power. Therefore, this can help us complement the conception of vinaya and at the same time re-consider the roles of samgha leaders. The system can have its vitality through the change. It means that the system is a limited truth available only in a specific society. In this respect, it will be a very meaningful effort to review the fundamental spirit of Buddha and to revive the flexibility of vinaya.
