직무관련 소송에 대한 경찰관의 인식 연구 = Police officer's perception of job-related litigation

국문 초록 (Abstract)

이 연구는 경찰직무관련 소송에 대한 이론적 논의가 아닌, 실증적 연구를 통해 소송에 대한 경찰관들의 두려움과 요구(needs)를 파악하여 대응전략을 마련하고자 하였다. 연구목적을 위하여 경기, 인천, 전라, 충청권역의 경찰서를 임의로 선정하여 이들 경찰서에 근무하는 남녀 경찰관을 임의표집하여 자기보고식 설문 조사를 실시하였다. 최종 653명의 설문이 실제 분석에 사용되었으며 설문의 내용은 직무관련소송 경험 여부 및 두려움, 피소의 원인, 직무관련 소송의 문제점, 예방방안에 관한 항목으로 구성하였다. 설문조사 분석결과 경찰관들은 소송을 제기당하는 주된 이유로 법집행 절차 및 정책의 모호성 때문이라고 인식하였으며 소송으로 인한 문제점 중 가장 중대한 것은 경찰 사기의 저하 및 경찰관의 심리적 스트레스라고 답하였다. 또한 직무관련 소송의 두려움을 평균이상으로 인식하고 있었으며 적절한 직무수행을 했음에도 불구 소송을 제기당할 수 있다고 생각하는 비율이 높은 것으로 나타났다. 마지막으로 경찰직무수행관련 소송의 예방방안으로 명확한 법집행 절차 및 가이드라인마련의 필요성을 가장 높게 평가하였다.

다국어 초록 (Multilingual Abstract)

This study aims to find out the needs of the police officers through empirical research rather than theoretical discussions about police officer's job-related litigation. In order to investigate the police officers' perception of police job-related litigation, police stations in Gyeonggi, Incheon, Jeolla, Chungcheong region were randomly selected to randomly sample male and female police officers and conduct self-reporting survey. Surveys of 653 police officers were utilized in actual analysis, and the contents of survey are composed of litigation experience and fear, cause of litigation, prevention measures regarding job-related litigation.
The results showed that police officers were more than average (3.11) in fear of job related litigation. It is also highly perceived(3.58) that there is a possibility of litigation even though they have performed their duties properly. Also, police officers answered the major cause of job-related litigation was the ambiguity of law enforcement process and policy. Also, they answered the most significant problem of litigation influencing police organization is demoralization of police. Among the prevention measures of job-related litigation, the police officers evaluated necessity of clear law enforcement process and preparation of guideline the highest.
