법과학 증거의 한계에 대한 논의 - 최근 미국의 논의를 중심으로 - = Discuss the limitations of forensic science evidence -Focusing on recent discussions in the United States-

In the United States, an advanced nation of forensic science, the misjudgment of forensic evidence in the past has become a problem and has experienced an unstable transition. Of course, this does not mean that US are currently maintaining a full level of forensic science, but in the United States, there have been numerous efforts to raise the level of forensic science to the next level, and it is still ongoing.
This paper examines what has been discussed in the United States overcoming the uneasy transition to forensic science, and seeks implications for the development of Korean forensic science.
Therefore, this article first suggested the establishment of a national forensic control tower at the national level, expand the budget support allocated to forensic science, develop standardized curriculum for future forensic scientists, and introduce the certification system of forensic science laboratory.

국문 초록 (Abstract)

법과학의 선진국이라고 할 수 있는 미국에서도 과거에 법과학 증거를맹신하여 발생한 오판 사례들이 문제가 되어 불안한 과도기를 경험했다고 할 수 있다. 물론 그렇다고 하여 현재 완전한 법과학 수준을 유지하고 있다고는 할 수 없지만, 미국에서는 법과학의 수준을 한 단계 높이기위한 수많은 노력이 있었고 또한 현재도 진행 중이라고 할 수 있다.
본 글은 미국에서 법과학에 대한 불안한 과도기를 극복하면서 논의되었던 것을 검토하면서 한국 법과학의 발전을 위한 시사점을 찾고자 한다. 왜냐하면 한국의 법과학은 미국과 유럽에서 처음 시작된 학문으로나라는 다르지만 법과학의 뿌리는 같다고 할 수 있다. 그러므로 미국에서 법과학의 불완전함으로 인해 발생한 문제점들과 이러한 문제점을 극복해가는 과정을 살펴보면 현재 과도기 상태에 있는 우리나라의 법과학에도 충분히 시사점을 줄 수 있을 것이기 때문이다.따라서 본 글에서는 먼저 국가 차원의 법과학 컨트롤 타워의 설립이필요하고, 법과학에 배분되는 예산지원을 확대해야 하며, 장래의 법과학자를 위한 표준화된 교육과정의 개발 및 법과학 실험실의 인증제도의 도입이 필요함을 제시하였다.
