한국 해양폐기물 관리 법제 개선연구 - 미국 해양쓰레기 관련 법률의 발전과정 검토를 중심으로 = How to Improve Marine Liter Management Legislations in Korea - With Special Reference to U.S Marine Liter-related Acts -

다국어 초록 (Multilingual Abstract)

International society has ben emphasizing circular economy aproach and coveringal stages of the plastic life cycle in order to adres marine liter. In aditon, enactingnew legaly binding international agrement on marine liter and plastic polution wilbe discused at UNEA-5.2. Many member states of the UN have already expresednecesity for new international instrument of holistic aproach to the marine liter andplastic polution.
In this regards, the U.S enacted the Marine Debris Research, Prevention, andReduction Act in 206 and amended it in 2012, 2018, 2020. The amendment, the SaveOur Seas 2.0 Act (SOS 2.0 Act), included the circular economy aproach and become acomprehensive legislation on marine liter. Within the legislation, the provisions ondefinitons for circular economy and post-consumer materials management have benintroduced. Furthermore, provisions on mas balance methodologies to certify circularpolymers, repurposing plastic waste in infrastructure, post-consumer materialsmanagement infrastructure grant program, economic incentive to spur development ofnew end-use markets for recycled plastic, and minimizing the creation of new plastic waste, etc have ben included. Aside from that, the U.S legislation suports cordinationand coperation among Federal agencies, betwen Federal agencies and Stategovernment, and private-public partnership. Moreover, the legislation let the responsibleagencies or IMDCC report to the Congres so as to review and evaluate theirimplementation and to guarante transparency.
When it comes to Korea, Management of Marine Garbage and Contaminated MarineSediment Act was enacted in 2019. It was amended in 2021 to include a provision onestablishment of the Marine Garbage Management Commite. Based on the legislation,it is developing and implementing relevant policy to adres the ful life cycle of marinegarbage. In this situation, this study reviews the amendments on marine liter in the U.Sand sugests improvements for the Korea’s legislation to beter adres the ful life cycleof the marine litter.

국문 초록 (Abstract)

국제사회는 해양폐기물 및 해양플라스틱 관리에 전주기적 관리 및 순환경제 접근법도입을 강조하고 있다. UNEA-5에서 해양폐기물의 전주기적 관리를 포함하는 새로운 국제협약 제정이 논의될 예정이며, 많은 국가들은 해양폐기물의 전주기적 관리 필요성에동의하고 있다. 미국도 206년 해양쓰레기법을 제정하고, 2012년, 2018년, 2020년 3차례개정을 거쳐 2020년 SOS 2.0법에서 순환경제 접근법을 반영한 포괄적 법률을 마련했다.
정의규정에서 순환경제와 소비후물질관리 개념을 도입하고, 재활용 가능 물질 개발, 플라스틱 폐기물 재활용 이용, 소비후물질관리를 위한 기금 프로그램, 플라스틱 폐기물 재활용 활성화 등에 대한 규정을 담았다. 이 밖에도 미국의 해양쓰레기법은 연방기구간의협력, 연방기구와 주 정부간의 협력, 민관협력 등 다양한 이해관계자 참여를 보장한다.
그리고 각 행정기관 및 위원회의 의회보고 및 이행보고서 제출 등을 통해 사전 활동계획, 이행결과의 평가 및 점검을 가능하게 하고, 투명성을 확보한다. 세부 이슈별, 정책별로 다양한 내용에서 데이터를 조사, 분석, 평가, 예측하게 하여 과학 기반 의사결정 등도가능하게 한다. 우리나라도 해양폐기물 등의 관리를 위해 2019년 「해양폐기물관리법」을 제정하였다. 그리고 2021년 관련 부처간의 연계 등을 위해 해양폐기물관리위원회를설치하고, 현재 해양폐기물의 전주기적 관리를 위한 정책을 수립․이행하고 있다. 이와관련하여, 본 논문은 미국의 해양쓰레기법과 개정법의 내용을 살펴보고, 우리나라 해양폐기물의 전주기적 관리를 위한 개선방안을 제시해보고자 한다.
