Recently the government establish many sorts of real estate policy in bad economic condition. The government is frequently intervening in the real estate markets. However, there is doubt that the intervening accomplish the intended goal. It was criticized that the government carried out inconsistant real estate policy and give a false impression to market participants. The meaning and role of real estate and real estate market is not small in our society. So it is very important that we consider every policy and legislation to the real estate market. We need to comprehend the character of real estate market, matter of real estate and real estate policy.
The government can use the various real estate policy to cope with the matter of real estate market. In case of market failure, the government can use the various real estate policy. This policy will be left a administrative means, but a large number of policy will be enacted legal system.
The public law don’t perform a single role in the relationship of the real estate market, but rather is classified according to the character. The public law should be divided into the formative public law forming the real estate market and intervening public law. Two kinds of law should be used differently. If not, the real estate market will be distorted and the market failure can’t be overcome.
